Shri. Soundappa S. Shetty and anr. ..Petitioners. State of Maharashtra and ors. ..Respondents. Vs. None Shri.P.A.Pol, APP. for the State. Petitioners. P.C. P.C.P.C. CORAM : R.S. MOHITE, J. DATED : 20th November, 2007.
This matter was called out yesterday when none was present. When it is called out today, the Advocate for the petitioners is absent. On perusal of the record, it appears that this petition has been filed against the issuance of Show Cause Notice to furnish a bond under Section-107 of the Code of Criminal Procedure, 1973. There are several allegations made out in the Show Cause Notice and the same are based upon the statements of the various witnesses examined by the Special Executive Magistrate, Vikroli Division, Mumbai. It is open for the petitioners to give reply to the said Show Cause Notice. This is not a fit case for interference in my jurisdiction under Article 227 of the Constitution of India. Hence, petition is dismissed. :2:
