Learned counsel for the petitioners states that State Government has now taken a decision by which petitioner’s society is allowed to be registered as Hamal Kamgar Co-operative Society Ltd. Since the decision of the State Government is in favour of the petitioners, it is not necessary to proceed further with this petition. Learned counsel for the petitioners submitted that in case if rival parties filed petition challenging the decision of the State government, petitioners may be allowed to raise the points in such petition, which are raised in the present petition and he may be allowed to withdraw the above petition.
In view of the statement made by the learned counsel for the petitioner that the decision of the State Government is in favour of the 2 WP 41 of 2011 petitioner, we permit the petitioner to withdraw the petition with a liberty that in case if any proceedings are filed by anyone challenging the decision of the State Government, it will be open to the petitioner to raise all these points taken in the petition and all the contentions of the petitioner’s are kept open.
