P.C.: The petitioner who was appointed in 1984 as a primary teacher applied practically at the fag end of his service tenure in July 2010 for change of his Birth Date. As per the Birth Date recorded in his Service Book, the petitioner was to retire on 31.12.2010 and, in fact, the petitioner has retired on superannuation. The representation of the petitioner for changing the Birth Date was rejected on the ground that the petitioner was required to apply within five years after appointment. The petitioner filed the application after the said period. In our view, such petition cannot be entertained when the petitioner approached this Court for change of Birth Date at the fag end of his service. The petitioner did nothing after 1984 2 wp674.2011 and the application was first made in February 2010 when the petitioner was to retire within few months. The petition, in our view, is without any substance and hence rejected. (P.B. MAJMUDAR, J.)
