1. The order passed in application No 856 of 2013 seeking final decree in respect of Acre 1-O0 in Sy No'57 of Shamshiguda village, Balangar Mandal, R.R. District is contrary to law and facl-s and is liable to be set aside'

2. The learned Judge ought to have secn that while seeking up final clecree, the State was necessary party to the proceedings since the properties in respect of which hnal decree was claimed is vested with the Governme nt' consequent upon abolishing of Jagirs'

3. The learned Judge ought to have secrr that by making an endorsement that Stal-e was not a necessary party to the proceedings, causes serious prejudice to the interest of the State.

4. The learned Judge ought to have appreciated that had notice been given to the State appropriate claim would have been made in respect of thc ProPCilY.

7. For ltett,:r- appreciation, it is necessary to excerpt the order dated 19.09.2Cr1.t passed in Application No.856 of 2O13 ir C.S. No.7 of 1958 by the le;rrned Single Judge. 8. The aforesaid order was followed by the decree dated 19.09.20i3 drafted in Application No'856 of 2013 in C'S' l{o 7 of 1958, which reads as under: "1. 3. Th: t the Petitioner who has purchased the lancl mea:;uring Ac.2-OO Gts., in Sy.No.57 of Sha:ns;iguda Village, Balanagar Mandal, R.R. Dislri(r, being part of item No.252 of Schedule .,A,, appen(i,ld to the preliminar5z decree, from the Delerrc zu'rts No.15, 12, A, a, rc, 20, 21, 22 and the lergal heirs of Defendants No.3, 4, S, 6, T , g, lO 6 Applicarion No.a56 of 2013 C.S. No.7 o{ 1958 & 11, was brought on record as Defendar-rt in C.S. No.7/1958, and is entitled to get the frnal decree passed in his favour'

4. That as per the orders of the Hon'b1e High Court in App1.No.495/2009 in C.S. No.7 of 1958, the Receivers-cum-Commissioners have submitted the scheme of partition along with' the plan, dividing the property in Sy.No.57 of Shamsiguda Village, by metes and bounds among the share holders and the Petitioner being thc alienee pendent lite, was accommodated hirn in the scheme of partition, being bonafide purchaser specihcally allotting Ac.2-00 Gts., of land to the petitioner being the pur-chaser from the share holders, and shown in the plan by metes ald bounds.

That the land allotted to the Petitioner by the Receivers-cum-Comrnissioners under the scheme of partition, is under the physical possession of the Respondents No.178 & 179 herein, and the Petitioner and the Respondents No. 178 &' 179 have amicably settled the matter and the Petitioner is allotted Ac.1-00 Gts, in Sy.No.57 of Shamsiguda Village, which is specihcally shown in the schedule and plan annexed hercto.

6. That by virtue of the purchase and in view of the above settlement the Petitioner is entitled to this final d.ecree to an extent of Ac.1-OO Gts., only out of Sy.No.S7 of Shamsiguda Village. On a perusal of the order passed by the iearned Single Judge' it is noticed that though the appellants, State, were made parties' it is spccifically mentioned that " (Respondents No l to 177, 182 to 184 are this applicrttion) and they are made as not necessary Parties to profonno parties."

In the ltnal clecree dated 19'09 2013, it is stated that the respondents/ petitioners purchased the land measuring Acs 2'O0 guntas in Sy.No.57 of Shamsiguda vi1lage, Balanagar \4andal' R R' District, being part of Item No.252 of Schedule "A" appended to the preliminary decree, from the Defendants No 15, 12, A' a' 19' 20' 2l' 22 and the legal heirs of Delendants No 3, 4, 5,6,7' 9' 10 & 11' who were brought on record as defendant in C'S No'7 of 1958' are entitled to get the fina1 decree in their favour' In the case on hand, though the appellants herein were made i i. party to the proceedings, it is specifically mentioned that they are not necessa4/ parties and they are made as proforma parties' As such' there was no occasion for the appellants herein to Iile their objections' \ \ 1 () IIAC,J&NVSK,J OSA No a oI2017 App lcariof No.a56 or 2013

12. The learrLed Single Judge in the order dated 19.09.2013 C S. No.7 ol1958 recorded that the appellants/ respondents had no objection in allowing the applicatiorl slnce they have entered into compromise lt is also observed that rLlready paper publication is ordered in Application No.495 ol 2OC') rrnd the same was published and iiled in the Court and thercalter. r I e Commissioner lilcd his report on I 7.07 2009. tt is further recorclerl that the learned Senior Counsel, Re,:eiver-cum- Commissioner a I so submits that he has no objection for passing a final decree. Flt <:orcling the above, the learned Single Jurtge allowed the application tt the extent o[ passing final decree only.

13. However, 1r. thc copy of the final decree, there is no mention or reference a[:ou I lhc compromisc of lhe appellar-r s herein, who representsl ltre State. District br:irr1g part of item No.252 of schedule ,,A,, ar-rnr:xed to the preliminary de<:r,:,: in C.S. No.7 of 1958. It is further recorded that the respondent/ pe titioner has purchased the land measurinl3 Acs.2.00 guntas in Sv Nc.57 of Shamshiguda village, Balanagar Mandal, R.R. Districl.

14. At this jtLn,:ture, it is signihcant to note that the Divisrion Bench of this court vitle rrder dated 09.01.2025 closed the c.s. N< .7 of 195g wherein at par€r Irlo.36 observed as under: 10 HAC,J&IIVSK,J Application No as6 ot20l3 a) C.S. No 7 of l95a "36. On a perusal of the paragraph 4(g) of the preliminary decree dated 06.04.1959, it is evident that the defendant Nos.2 to 22 were entitied to the properties mentioned at item Nos.230 to 254 of Schedule A' annexed to thc preliminar5r decree, in case the sarne arc restored or released in favour of Asman Jairi Paigah. hr the instant case, admittcdly, therc is no material to indicate that the propelties mentioned at seria-l No.230 to 254 of Schedule 'A' to the preliminary decree have been restored or leleased in favour of Asman Jahi Paigal'r. It is pertinent to note that as per para 4(g) of the preliminary decrce dated 06.04.1959, the Commissioners-cum-Receivers have the power to sel1 the property by way of public auction and exercise all powers necessary for effecting the division of the sale bctween the defendants No 2 to 12 and 14 to 22. Accordingly, each son rvould get 2 133 arrd each daughter would get 1 / 33 in the propertics of Schedule 'A' except items 230 to 254 of the Schcdule and items of properties a'ilotted to the plair-rtiff. The defendant Nos.2 to 22 wlll get Lheir strarc, namely, each son getting 2/35 and each daughter getting 1/35 from the arrears of income future income, compensation or commutation or sale proceeds of the items 230 to 254 of Schedule A' detailed under the head of "Makthas" in case of the same are restored or released in favour of Paigah Asman Jahi "
