ORDER: This Writ Petition is filed under Article 226 of the Constitution of lndia seeking the following relief: "...fo issue a writ or order, orders or directions more particularly one in the nature of Writ of Mandamus - i) dectaring the action of the Sth and 6th respondents in inbrteing in private life and personal liberty of petitioner and illegally taking his mobile phone and going through his perso nal information and huge recording data and harassing him to book in false cases and also binding over him in view of assembly elections and also the action of the Sth and 6th respondents not to sent police to residential house of petitioner in order to call him to police station to 2 ty/.p. No.l#/*r0,, ii) harass him as illegal, arbitrary, discriminaative, mala fide, unjust, colorable exercrse of powers besrdes violative of the Articles 14 and 21 of the constitution of lndia; and consequently, direct the respondents not to interfere in his personal tife and liberty and also direct the 3d and 4th respondents to take action against the Sth and 6th respondenfs for iilegat confiscating the mobire data of petitioner and accessing of it and deteting the same from his mobile and also direct the Sth and 6th respondenfs nof to sent potice to residentiat house of petitioner in order to cail him to porice station repeatedly without there being registration of any crime against him; and pass such other order orders. -."

2. I have heard [\Is. pranitha G, learned counsel, representing Ms. s. Priyanka, k:arned counsel for the petitioner and Mr. D. pradeep, learned Assistant Government pleader for Home, appearing for respondents. 3' Learrred counsel for the petitioner submits that the respondent- Police authrlrities, without any laMul justification, are interfering with the petitioner's f)ersonal life and liberty, and are harassing him by threatening to register f;alse cases and initiate bind-over proceedings in view of the forthcoming Assembry Erections. Learned Assistant Government Pleader for Home submits that the allegations made by the petitioner are unsupported by any credible or acceptable material, and that the contentions raised against the respondents/Police are unfounded. He further contends that if the petitioner had any genuine grievance, he ought to have availed himself of the alternative,remedies avaitable under law. Accordingly, he prays for dismissal of the petition.

6. The petitioner's grievance is that the respondents/Police are interfering with his personal life and liberty and are harassing him with threats of registering false cases and initiating bind-over proceedings.

Having regard to these assertions, and in light of the respondents' categorical denial of the allegations of interference, it is pertinent to note that even while exercising their lawful authority, the powers of the Police are subject to limitations prescribed under law. Therefore, the respondents-Police authorities al'e hereby directed to refrain from interfering with the personal life and liberty of the petitioner, which are guaranteed under Article 21 of the Constitution of lndia, except in strict accordance with law and by duly following the prescribed legal process. 4 N7R,/ lY.P.
