A consequential prayer is sought to direct respondent Nos.1 to 3 to implement the provisions of the said Act and further to direct respondent Nos.4 to 11 not to harass the petitioners by imposing fine, eviction and confiscation of goods, etc.

2. Heard leamed counsel for the petitioners, leamed Standing Counsel for respondent No.4 and Mr. R.Laxmikanth Reddy, learned Assistant Government Pleader for Home appearing for respondent Nos.s to 11.

Learned Standing Counsel appeanng for respondent No. 4 submits that the provisions of the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Acl,2014 ('the Act of 2014') are being duly implemented in letter and spirit. lt is further contended that the petitioners have failed to place on record any specific instance of violation or non-compliance with the statutory mandate. ln the absence of any material particulars substantiating the grievance, it is urged that the writ petition does not survive for adjudication. 2

Learned Assistant Government Pleader for Home, while endorsing the above submission, contends that the re,r )ondenvpolice have neither interfered with nor created any obs r tction in the implementation of the provisions of the Act of 201 4 lt is further emphasized that the role of the police is only anci lrry in nature, confined to rendering assistance for enforcement of tl r provisions of the Act strictly in accordance with the procedure estirl lished by law and in furtherance of the objectives sought to b,: achieved by Parliament in enacting the statute.

Having regard to the relief sought in the w-i petition, the submissions advanced on behalf of the respondents, ar i the admitted position that the statutory framework under the Act o 2014 is under implementation, this Court is of the considerec opinion that continuation of the present writ proceedings is rendered rnnecessary. 7 . The Hon'ble Supreme Court in Maharashtra t ikta Hawkers Union v. Municipal Corporation, Greater Mumbait,l-i s categorically recognized that the Act of 2014 is a complete code pror' Cing adequate safeguards for the protection of the rights and live i rood of street vendors while simultaneously ensuring regulation in ,ublic interest. Once the statutory machinery is in operation, interventit r by this Court under Article 226 of the Constitution of lndia is warre r ted only upon ./: 2014) 1 SCC 490 3 demonstration of specific illegality or arbitrariness, which, in the present case, has not been established by the petitioners.

8. Nonetheless, it is clarified that the dismissal of this writ petition shall not preclude the petitioners from instituting appropriate proceedings or availing any other remedies available to them in law in the event of any violation or infringement of their rights under the Act of

2014. Subject to the above liberty, the writ petition is disposed of. There shall be no order as to costs.
