3. I have heard Mr.Rla-xmikanth Reddy, l,:.mecl fusistant Govemment Pleader for Home appearing for rr spondenr Nos. Ito4.
4. kamed fusistant Government pleader for. Home submits that the pedrioners' prayer is essentially for 1 rant of police 2 o protection, ,lLgi"g inaction on the parr of respondent Nos. 1 to 4/pohce authorities. It is contended that, if the petitioners were genuinely aggrieved by the failure of the police in extending such protection, they ought to have invoked the remedies expressly availaHs under the C-ode of Criminal Procedure, lg73 (C"r.P.C)/Bhanti:7a Nagarik Suraksha Sanhita, ZO23 (BNSS). Without exharsting those starutory remedies, invocation of writ jurisdiction under Ardcle 226 of the Constirution of India is not maincainable. 5 I have carefully perused the mater-ials placed on record.
6. The substance of the petirioners' case is that the police authorities failed to provide protecrion in punuance of the order datedt5.t0.2015 passed in I.A No. 729 of 2015 n O.S. No. 529 of 201,5.Inthis regard, it is pertrnent to note that a C-oordinate Bench of this Cotrrt, in Nfl.P. No. 8958 of ZOZS dated 13.06.2025, has fur dy considered a similar issue. ft was held therein that unless the petitioners demonstrate steps taken to enforce the decree/order 3 passed in a civil surt by irutiaring approu iare execurion proceedings, including a requesr therein for pcl ( e prorection ro facilitate the irnplementation of the decree, sucl-r r wnr petition is not rnaintainab le.
7. In view of this settied position of larv, t:r: prayrer of the petitioners, seelcing direct police prorecrion on rli: strength of an ad rnterim ordeq cannot be entertained. Nevr theless, having regard to the pleadings on record and also takrng ir :o consideration the fact that an interim order has been granted b1, : Lis (irurt, tiberry is reserved to the petitioners ro avail themselves (,t rhe appropriate remedies before the comperenr Executing Court. 8 Accordingly, the writ petition stan& dispos: I of. Therc shall be no order as to costs. Misceilaneous Petitions, pending if any, shal rtand closed. - Sc -8.
