The case of the petitioners, in brief, is that the petitioners are in possession of the lands admeasuring Ac.1.00 guntas, Ac,1.10 guntas, Ac.1.20 guntas situated in Chinthakunta Village, Varni Mandal, Nizamabad District in different survey numbers. The Government ailotted assignment pattas to the petitioners in the year 2006 and 2007. On 23.05.2015 and 24.05.2015 the 3'd respondent without issuing any notice highhandedry started digging trenches by using heavy machinery claiming the said land to be the forest land. When the petitioners tried to stop the J SN, J wP 4559 2025 digging trenches, the resPondent officials threatened the petitioners that crimina I complaint will be filed against the petitioners under the Preventive Detention Act' Aggrieved by the respondent, the present writ petition IS st id action of the 3 filed. 5. The said interim order dated 04.06.2015 passed in favour of the petitioners in W.p.M.p. No. 19511 of 2015 in the present writ petition is in force as on date.

6. Learned counsel appearing on behalf of the respondent No.3 filed counter affidavit and in particular para No.4 of the counter affidavit is extracted hereunder: "4. In reply to averments made in para No.2 & 3 of the petitioners Affidavit, it is respectfully submitted that, the contention of the Petitioners that, the 3.d Respondent herein Divisional Forest Officer, Nizamabad is digging trenches in the Petitioners agricultural lands without issuing any notice and interfering with peaceful possession of the lands admeasuring Ac. 1-00 gts., Ac-1-10 gts., Ac. 1-20 gts and Ac. 2-00 gts., situated in Chintukunta Village, Varni Mandal, 5 SN, J wP 4559 2025 Nizamabad Distrlct ls not correct and, untenable' The fact is that, as per the standing instructions of the Prl'Chief Conservatrrr of Forests (Head of Forest Force), Telangana State, Hyderabad vide Rc.l'lo' 5780/2O15/sF-l' dt:- 25.04.2015 has instructed all the Divisional Forest Officers of Telangana State to go for deep trench around the periphery of the Forest Block, so as to protect the forests lands from encroachrnents and take up plantations work under Haritha Haram Scheme. Any assignments made in R'F' area shall be nullrfied".

The learned Assistant Government Pleader for Forests placing reliance on the averments made in the counter affidavit filed on behalf of respondent No.3 contends that the staff and respondents had never interfered into the petitioners' peaceful possession of the petitioners' land and that the petitioners are trying to encroach into the Reserve Forest in Mosra Extension Forest Block under the guise oF assignment of patta issued in favour of the petitioners by the revenue officials in Sy.No.646 which is also Reserve Forests Land and therefore the 1 8 SN, J wP 45i9 2025 respondents may be directed to .initiate appropriate action against the petitioners in the event petitioners encroach or illegally occupy the Reserve Forest in Mosra Extension Forest Block.

8. A bare perusal of the counter affidavit in particular para No.4 (referred to and extracted above), clearly indicates as borne on record that certain extents of lands in Sy. Nos. 647, situated at Chintakunta vilage. Nizamabad Mandar and.District as having been assigned in favour of the petitioners herein by the Revenue Department. However, the specific plea of the respondents in the counter affidavit that the petitioners are trying to encroach into the Reserve Forests in Mosra Extension Forest Block of Nizamabad Range, which is notified as Reserve Forest, is disputed by the learned counsel appearing on behalf of the petitioners.
