1. We have heard learned counsel appearing for learned counsel appearing for the appellants, learned counsel appearing for the respondent Nos.S and 6 and the learned Assistant Government Pleader for Women Development and Child Welfare Department appearing for the respondent Nos.1 to 4.
2. We have no reason to entertain the present Writ Appeal since the Appeal admittedly arises out of an interim order dated 24.11.2C/25 by the learned Single Judge passed in LA.No.2 of 2025 in W.P.No.2l692 ot
2025. t 2
3. By the impugned order, the learned single Judge suspended the proceedings uide Appeal No.O44lAT /DWO/2025, dated OS.OZ.2O2S passed by the Chairman, Appellatc Tribunal and Collector and District Magistrate, Nalgorrda subject to the condition that the nrit petitioner No' 1 shall pay Rs.1o,00o/- each to the respondent Nos.5 and 6 (unofficial respondents), and the n,rit petitionef No.2 shall also pay Rs.10,000/- each to the respondent Nos.5 and 6 along with attending of the medical necessities of the respondent Nos.S and 6 and by paying their medical bills equally. The r,r,rit petitioner'Nos.1 and 2 *,ere directed to pay the amount on or before the 101r, of ever_y calcndar month. 4' The writ Appellants are tire writ petitioners before the learned Single Judge. The writ petitioncr l{o.1 is the grandson and the writ petitioner No'2 is the son of the respondent No.-5. The writ petitioners prayed for Writ of Certiorari for sctting arside Lhe order dated o3.o1.2o2s passed by the respondent No.2/thc l)istrict collector, Naigonda District rn an Appeal by directing to retransfer the land in favour of the respondent No.5.
5. we have se'crar reasons for clismissing the writ Appeal. First, the writ Appeal has been filed from an i,terim order dated 24.Lr.202s. The interim order indicates that the matter was made returnable on 22.12.2o2s. second, the rvrit petitioners/appellants filed an I.A.No.3 of 2025 in the said u'rit petition for modificatiorr of the interim order dated 24'1L'2025' The Proceeding sheets dated o8.r2.2o25 in the writ petition shows that the lear,ed single Judge has considered the prayer and listed the nratter on 1o.r2.2o2s under the caption ,for Being Mentioned,, and j/ J on the returnable date i.e., lo.l2.2o2s shows that the counsel representing the petitioners sought for an adjournment to file a compliance Memo in respect of the order dated 24.1L.202s. Ironically, the very same order dated 24.11.2025 has been impugned in the present Appeal.
6. It is evident that the direcrions on the appellants to pay sum of amounts to the respondent Nos.S and 6 was given as a condition precedent for suspending the order dated 03.07.2025. The writ petitioners filed I.A.No.3 of 2025 in the said writ petition for modify-ing the interim order dated 24.11.2025 and sought time to file Compliance Memo on that very same order and thereafter filed the present Appeal from the veryr same order dated 24.1I.2025. Hence, the Appeal is not only misconceived, but is also an abuse of process of law.
7. W.A.No.153O of 2025, along with all other connected applications, is accordingly dismissecl. The appellants shall pay costs of Rs.5,00O/- to Counc.il for Green Revolution located at 1448, Street No.17, Banjara Green Colony, Road No.12, Banjara Hills, Hyderabad-s00o34, within seven days from the date of receipt of a copy of this order.
