Respondents ORDER:(ORAL) Heard Ms. Sahithi Sri Kavya Mukkera, leamed counsel for the petitioners, and Mr. Pasham Mohith, leamed standing counsel for the GWMC, appearing for respondent Nos.2 and 3.

The case of the petitioners is that petitioner No.l is the owner of the land admeasuring Ac.0-26 guntas and petitioner No.2 is the owner of the land admeasuring Ac.0-04 guntas in Survey No.5l2lC/B situated at Bollikunta Village, Khila Warangal t !!-r- V r'+'rrEr 2 Mandal, Warangal District. The petitioners c t tained NALA permission vide Proc.No.2300079007 dated 31.01.1023 from the Revenue Department and building permission vlde Register No.P.P.B/2O13 dated 18.03.2013 from the Bo likunta Gram Panchavat.

3. While so, respondent Nos.8 to 12 have obt, ined tentative layout vide L.P. No.0391/LOl3OO6l2024 dated 20 )0.2024 for an extent of Acs.3-8.85 guntas ln Survey Nos.5l.l A3/lll12 and 5l2lA3l2 by encroaching the land of the petitioner adnreasuring Ac.0-10 guntas in Survey Nos.512lclBll and 512,( lBl2. ln that connection, a complaint has been lodged with M: mnoor police Station in FIR No.86 of 2023., wherein charge sheet u as also filed.

4. It is submitted that a suit in O.S. No.662 of 2)23 was filed by the petitioners in the Court of II Addl. Junic r Civil Judge, t Warangal, against respondent Nos.9 to 12 seel: ng perpetual injunctiori, which is pending. On request of t r : petitioners, respondent No.5 directed respondent No.7 to conrl .ct survey of subject land. Accordingly, respondent No.7 conduc ed survey in File No.FVl 28912023 and issued report whict shou,s that J respondent Nos.S to 12 are entitled only for an extent of Acs.3-14 guntas. However, they occupied Acs.3-24 guntas which includes the land of Ac.0- l0 guntas owned by the petitioners. The petitioners made several representations to the respondent authorities including representation dated 27.01.2025 to take action against respondent Nos.8 to 12 for cancellation of layout issued their favour. However, no action has been taken, as such, they are constrained to approach this Court.

5. Leamed standing counsel for GWMC submitted that representation of the petitioners dated 27.01 .2025 wifl be considered and orders will be passed in accordance with law. I I

In view of the above, the writ petition is disposed of, directing respondent No.2 to consider th'e representation of the petitioners dated, 27.01.2025 seeking cancellation of layout issued in favour of respondent Nos.S to 12 vide L.p. No.039l/LOl3OO6 12024 dated 20.10.2024, and pass orders, by issuing notice to the petitioners, respondent Nos.S to 12 and all other concemed / interested persons, and by affording opportunity of hearing to 4 thern, within a period of four (4) weeks from the dirr : of receipt of a copy of this order. 7 . As this order is passed without entering int,r merits of the case, notice to respondent Nos.g to I 2 is d s tensed with. I['respondent Nos.8 to 12 are in anyway aggrievec ;y this order, they are at liberty to approach this Court seeking rt rdification of this order. There shall be no order as to costs.
