This Petition coming on for hearing, upon perusing the Memorandum of Grounds of Criminal Petition and upon hearing the arguments of Mr. Ragam Vishal, Advocate for the Petitioners and the Mr. Jithender Rao Veeramalla, Additional Public Prosecutor on behalf of the Sole Respondent. S.Chaitanyapuri) respondent ORDER This Criminal Petition has been filed aggrieved by the docket order passed by the XI Additional District and Sessions Judge, Ranga Reddy District at L.B.Nagar in C'rl.R.P.No.51 of 2024, dated 21.11.2025 where under, the criminal petition filed by the petitioners/accused Nos.l and 2 is dismissed for default.

2. Heard Mr. Ragam Vishal, learned counsel for the petitioners and Mr. Jithendar Rao Veeramalla, learned Additional Public Prosecutor for respondent.

3. Learned counsel for the petitioners have submitted that the petitiixrers are arrayed as accused Nos.l and 2 in cC.No.630l of : I I 2 2018 on the file of learned Judicial Magistrate of First Class, Special (Mobile) courl-cum-lv Additional Merropolitan Magistrate-lV Additional Junior Civil Judge, Ranga Reddy District at L.B.Nagar, petitioners have filed application in Crl.M.P.No.8l8 of 2023 under Section 239 of Cr.P.C for discharging them from the offence under Section 420 of IPC, wherein, the Trial Court dismissed the said application on

01.05.2024, aggrieved by the same, the petitioners have filed Crl.R.P.No.Slof 2024 on the file of XI Additional District and Session Judge, Ranga Reddy District at L.B.Nagar, and on

21.11.2025, the learned Session Judge dismissed the said petition on the ground of default.

4. He further submitted that the petitioners as well as the counsel appearing on behalf of them could not appear before the learned Sessions Judge due to unavoidable circumstances, unless the docket order passed by the learned Sessions Judge dated

21.11.2025 is set aside, the petitioners will be put to great hardship and petitioners are willing to abide by the conditions which are imposed by this Court. ; I 4 l t. L I / 3 5. Per contra, learned Additional Public Prosecutor submitted that the petitioners were absent in several adjournrnents and they are not co-operating for disposal of the criminal revision petition. Due to the same, learned Sessions Judge dismissed the criminal revision petition and the trial couft has rightly disrnissed the petitioner as default.

Having considered the submissions made by the respective parties and after pursuing the material available on record, it reveals that the petitioners/accused Nos.l and 2 have filed application i.e., Crl.M.P.No.818 of 2023 for seeking discharge them in C.C.No.630l of 2018 and the same was dismissed by the 'learned trial court on 01.05.2024. Aggrieved by the same, petitioners have filed the Crl.R.P.No.5l of 2024, before XI Additional District and Sessions Judge, Ranga Reddy District at L.B.Nagar and the same was dismissed for default. The specific case of the learned counsel for the petitioners is that the petitioners are residents of Bangalore and due to unavoidable circumstances, they could not appear before the Sessions court and the petitioners are willing to abide by any conditions imposed by this court. \ 1\ ! Taking into considemtion the peculiar facts and circumstances of the case and submissions made by the learned counsel for the petitioners, this court is of the considered view that if one opportunity is given to the petitioners, no prejudice will be caused to the prosecution. Accordingly, the docket order dated 21.11.2025 is set aside, subject to condition that the petitioner shall pay an amount of Rs.2,000/- to the High Court Legal Services Authority on or before 09.01 .2026, the petitioners are directed to appear before the Sessions court whenever the matter is posted.

8. tf the petitioners fail to co-operate with the disposal of the case, the learned Sessions Judge is entitled to proceed with the matter in accordance with law
