Petitioner Respondents In this Writ Petition, the petitioner is challenging the action ol respondent No.5 Returning Officer in allowing the apptication/ nomination of respondent No.6 ignoring the representations of the petitioner's son dt.03.12.2025, 08.12.2025 and 08.12.2025 with regard to the age of respondent No.6 who is contesting for Sarpanch Dhorpalle Gram Panchayat, as illegal and arbitrary. .- -\EFt! l 2

Learned counsel lor the petitioner submits that espondent No.6 has not completed the age of 2l as per her SSC Mer o and Bonafide Certificate and therefore, she is not eligible for r;r ntesting in the elections. She submits that the petitioner's son has marl representations to the Retuming Officer on 03.12.2025 &. 08.12.2025, hou,ever, as the objections were not considered, he has made another spresentation to respondents No. I and 4 on 08.12.2025, but the',, were also not considered and the respondent No.6 was allowed to c( r tL'st the election and that the petitioner was also one of the contesting r tndidates in the sub.iect election

Learned Government Pleader for Panchayat Ra has submitted that the subject represcntation was received on 09.12.-l r25 whercas the scrutiny of the nominations was concluded on 03.12 1( 25. lt is further submitted that respondent No.6 has submitted icr age-related declarations supported by her SSC Certificate alon,l with Bonafide Certificate, PAN Card and Aadhaar Card and therr: is no material indicating any prima J'acie or apparent disqualificrt on which was produced before the Retuming Officer at the time , 1' scrutiny and therefore, the nomination of respondent No.6 has been lLr cepted 3

Upon hearing both parties, this Court finds from the schedule of election that the election of the concemed village was held in the second phase and the date of scrutiny of nominations was 03.12.2025 up to 5.00 PM. Neither the petitioner nor her son has submitted any written objections before the authorities on 03.12.2025 and the evidence produced before this Court is only the representations of the petitioner's son dt.03.12.2025 which was received by the authority on 09. 12.2025 as per the endorsement thereon and another representation dt.08.12.2025, i.e., both after the date of scrutiny of nominations. Therefore, at this stage, this Court is not inclined to interfere with the process of election. However, the petitioner is at liberty to raise her objection in an election dispute if respondent No.6 succeeds in the election.
5. The Writ Petition is accordingly dismissed. No order as to costs
