The petitioners herein have filed I.A.No.1343 t f 2025 before the Trial Court under Order XXXIX, Rules 1 and 2, ret C with Section 151 of CPC seeking an ex parte ad-interim mandit ory injunction directing thc responCents, their members, aEents, :mployees, or any persons claiming through or under them lr any manner whatsoever whether directly or indirectly to immtl lia te ly restore the water supply to petitioners flat bearing No.303, s tuated at MSR Kunwar Rani Palace, Methodist Colony, Kundanbat h, Begum pet, Hydera bad.

Learned counsel for the petitioners submits :l at because of the existing pipeline provided by respondent No.1 ;ociety having got rusted, decayed and rotten, and the said pill:line being GI Pipes the water coming to the kitchen was rusty ar( contaminated water not consumable for domestic usage. T herefore, the petitioners with their own expenses substituted the : eid pipeline by Page 3 oF 4 a separate PVC pipeline so as to ensure that clean drinking water is made avallable in the kitchen. He further submits that he has taken a separate connection from overhead tank only for drinking and cooking purposes and not for any other purposes, and it is this which was disconnected. However, the Trial Court found the request for an ex parfe ad-interim mandatory injunction to be prima facie not strong enough and issued urgent notice to the respondents calling the matter on 08.01.2026.

Considering the fact that the nature of dispute from the documents made available apparently seems to be the disconnection of the drinking water supply meant exclusively for drinking and cooking purposes, this Court is prima facie of the opinion that a strong case for interim injunction is made out by the petitioners before the Trial Court.

In fact no prejudice would be caused to the Society if the pipeline would be restored and after hearing the parties, if the petitioners would fail to prove their case, the Trial Court could have then ordered for disconnection of the same. However, not granting I J a any interim injunction woulcj lead to the petitionr: s suffering from not having clean water for drinking and cooking pu poses.

7. In view of the same, this Court is not inc i led to keep the Civil Revision Petition pending any further. Accor tingly, this Civil Revisiorr Petition is disposed of qranting interim in j nction in favour ol' the petitioners. Consequently the respondent:; are directed to ensure that until the matter is taken up by the Trial Court for consideration of LA.No.1343 of 2025, the pipelin() which has been disconnected be restored immediately subject tc cutcome of the I.A.No.1343 of 2025. 8, As a sequel, miscellaneous petitions pend i rg if any, shall stand closed.
