2. Heard Sri A. Suhas Chary, learned cc't petitioner and Srl L.Ravinder, learned Assistar EVV, J Wp_39231 _2025 nsel for the I Government Pleader for Revenue appearing for the respon(l Ints and with their consent, this writ petition is being taken ulr lor disposal at the admission stage.

Learned counsel for the petitioner would ; rbmit that the petitioner is the orvner and possessor of the Plot I o.6/ Part to an extent of 302.5 square yards, situated in 3 r"No.336/ 1 of Maheshwaram Village and Mandal, Ranga Redcl1 )istrict having purchased the same under registered sale deed bearing document No.1910 of2000, dated 09.06.2000.

4. A careful examination of the sale deed bea :rng document No.1910 of 20OO reveals that the petitioner has p rrchased open plot. It is not t he case of the petitioner thrr the property purchased by him is agricultural land and tha' :e paid stamp duty or registratron fees on acre basis. The schec ule of property in the sale deed establishes that the nature of tL.t property is an open plot, admeasurrng 302.5 square yards. Jt 1s settled 1aw that the Survey Department has the authority tc :onduct survey and demarcate lands in accordance with the pr rvisions of the Telangana Land Revenue Act, 1317 Fasli (Act \ r. VIII of 1317 3 Evv, J Wp 39231 102-5 Fasli), the Telangana Survey and Boundaries Act, 1923, and the Rules framed thereunder. The Government has issued various circulars .specifying the conditions for conducting surveys, particularly F-Line (field measurement) surveys. Individuals requesting such surveys are required to submit specific documents, and if the conditions stipulated in the circulars are fulfilled, the survey ald boundar5r fixation may be conducted. The Commissioner, Survey, Settlements, and Land Records, exercising powers under the Telangana Survey and Boundaries Act. 1923, issued relevant circulars from time to time vide Rc.No.N1/6543/99, dated 25.O7.2OO1, Rc.No.Nl/1408/07, dated 1 3.07.2007, and Rc.No.N2l 174 t / 20 10, dated 1 8.05.20 10 stipulating the conditions for conducting survey of private lands. The said Circulars outline that only agricultural lands are eligible for survey by the Survey Department. In contrast, individuals owning plots within approved layouts, municipalities, Gram Panchayats, or Municipal Corporations are required to engage Licensed Surveyors appointed by the Government for such surveys, as these lands are no longer I considered agricultural. In the instant case, the petitioner,s land is clearly identified as open plot but not agricultural land. Since the petitioner's property is not an agricultural.land, the Survey 4 EvV, J wp 39231 2025 Department has no jurisdiction to conduct F-Lint: ! urvey as per the Cirr:ulars issuerl by the Commrssioner' Survey ' Settlements' and Land Records. For the aforesaid reasons' thlr; Court is not inclined to direct the respondents to considcr the F-Line application submitted by the petitioner' However' he petitioner is at liberty to take the services of licensed ;un'eyor for conducting the survey o[ his property i e, open plr t' if he is so advised.
