2. Aggrieved by the action of the respondent No.3 in refusing to receive, register and release the Sale Deed in respect of residentia-l house bearing H.No.3O-22O124/E (PTI No.117O8 13378), on Plot No.24/E in Sy.Nos.438 and 439, to an extent of land admeasuring

75.0 Sq.yards (or 62.7 Sq.mtrs) out of 92.0 Sq.yards (or 76.91 1 a Sq.rntrs) with a plinth area of 200 Sq.feet of AC- Roof, situated at O1d Safilguda, Ncredmet, Malkajgiri, now under lI-lMC, Malkajgiri Circle ar-rd Manclal. tl-re then Ranga Reddy Disl- :t, nou' Mcdchal- Malkajgiri District, the petitioner filed the prescrl Writ Perition'

Learnecl Assistant Government Pleader lor Stamps and Registration submits that the petitioner ha s zrpproached this Court seeking registration of the said clc:un-rent lvithout presenting it be fore the Registering Authorit,r'. If the petitioner presents the document to the Registerinl authority, the respondent authorities will receive the sam: and follou' the procedure. If there are any objections, appropri: 'e orclers shall be passed as contempiated under Section 71 of th: Registration Act, 1908 (for short, 'the Act, 1908'). In view of - re same, learned Assistant Government Pleader requested this Collrt to pass appropriate orders.

The Sectron 71 of the Act, 1908, reads as f I 1ou's: Reasons for refusal to register to be recorded - (1) Euery Sub-Registrar refusing to register a docutnent, except otr the ground that the propertA to u'l t'h it relates is not situatecl ttithtrt his sub-distict shall mcl e an order of refusal and recorded his reasons for such or; ''r in' his Book No.2, onct endorse the words "registration t < fitsed" ort tLe doanment; and-, on appticotion made by anA p. -son. executing or claiminq under the docunent, shall, tt'titltott Paumenl and \ l 3 unnecessary delag, giue him a copg of the reasons so recorded. (2) No registering officer shall accept for registration a doanment so endorsed unless ond until, under the prouisions hereinafter contained, the document is directed to be reglstered.

In view of the aJoresaid submissions, coupled with the provisions under Section 7l of the Act, 1908, this Writ Petition is disposed of directing the Registering Authority to receive, register and release the subject document in respect of the subject property, subject to the petitioner complying with the provisions of the Act, 1908 as r.r,ell as the Indian Stamp Act, 1899. It will be open to the Registering Authority to refuse the document presented before it, if there are any objections, by duly assigning reasons in support of such decision and communicate the same to thg petitioner thereon. It is made clear that this Court has not expressed any opinion on the merits of the case or the entitlement of the petitioner to get the subject document registered.
