2. Aggrieved by the action of the respondent No.3 in refusing to receive, register and release the Sale Deed in respect of residentia-l house bearing H.No.3O-22O124/E (PTI No.117O8 13378), on Plot No.24/E in Sy.Nos.438 and 439, to an extent of land admeasuring

If the petitioner presents the document to the Registerinl authority, the respondent authorities will receive the sam: and follou' the procedure. If there are any objections, appropri: 'e orclers shall be passed as contempiated under Section 71 of th: Registration Act, 1908 (for short, 'the Act, 1908'). In view of - re same, learned Assistant Government Pleader requested this Collrt to pass appropriate orders.

In view of the aJoresaid submissions, coupled with the provisions under Section 7l of the Act, 1908, this Writ Petition is disposed of directing the Registering Authority to receive, register and release the subject document in respect of the subject property, subject to the petitioner complying with the provisions of the Act, 1908 as r.r,ell as the Indian Stamp Act, 1899. It will be open to the Registering Authority to refuse the document presented before it, if there are any objections, by duly assigning reasons in support of such decision and communicate the same to thg petitioner thereon. It is made clear that this Court has not expressed any opinion on the merits of the case or the entitlement of the petitioner to get the subject document registered.
