4. The learned Assistant Government Pleader for Home submits that the relief sought in the present writ petition-namely, a direction to the potice authorities to register a criminal case-is not maintainable under Article 226 of the Constitution of lndia, in view of the well-settled legal position laid down by the Hon'ble Supreme Court.
5. I have carefully examined the materials placed on record.
6. The grievance of the petitioner, in essence, is that despite having lodged a written complaint on 18.06.2016, the concerned police authorities failed to register a case. Aggrieved thereby, the petitioner has d -'t -r, 2 approached this court under Article 226 ol the constitution of lndia, seeking a urrit of mandamus directing the police to register a crjme.
7. The legal position on this issue is well seftled and no longer res integra. ln tjakn Vasu v. State of u.p. & Others (AtR 2OO8 SC 907), the Hon'ble Supreme Court categorically held that when the grievance pertains to the refusal of the police to register a First lnformation Report (FlR), a writ petition under Article 226 is ordinarily not maintainable. The Court explained that the Code of Criminal procedure, 1973 (,.Cr.p.C.,,) provides an adequate and efficacious statutory remedy for such situations. This principle has been consistenfly reaffirmed. Notably, a three_
8. . Judge Benr:h of the Hon'ble Supreme Court in M. Subramanram v. S. Janaki & Others (AlR 2020 SC 387) reiterated that the proper remedy for an aggrieved person in such circumstances lies in invoking the procedure under the Cr.p.C., rather than direcfly approaching the High Court under its writ jurisdiction.
9. ln the present case, no exceptional or extraorrlinary circumstances have been shown that would justify the exercise of writ jurisdiction by this Court under Article 226. The statutory scheme under the Cr.p.C. provides sufficient and efficacious remedies before the competent J Magistrate, and the petitioner is at liberty to avail himself of such remedies, in accordance with law, should his grievance still subsist.
10. , ln view of the above discussion, the writ petition is dismissed as not rnaintainable. There shall be no order as to costs. , Miscellaneous Petitions, pending if any, shall stand closed' /TRUE COPY/ SD/-G. JYOTHI ASSISTANT REGISTRAR -r(-? SECTION OFFICER I To,
