Ms.Thakur Roopa Sirrgh, learned couns( 1 for petitioners submits that in some$ ItaI similar circutt r tance s, $'hile dealing with Writ Petition No.201 21, of 2O2i> tl-rrs Cour-t by order dt. 14 .O7 .2025 directed the responclc r [s auth orities therern to relcase the service counection, s ubjt:ct to the compliance of tl-rc statutory reqr-tirements b', the petitioner therein, and hence, requested this Court to l)as I silnilar order in the present Writ Petition also

4. Recently, the Hon'ble Supreme Courr n Raiendra Kumar Barjatga v, U,P. Aoas Euam Vikas Parishadt, in the larger public interest, issued directions irr Lddil.ion to the I 2024 SCC Onlinc SC i767 3 directives issued in Re: Directions in the maffer of demotition of structures. Relevant for the purpose of this case are: "(iv) A1l the necessary service connections, such as, trlectricity, rtatcr supply, se\r,eragc uonnection, etc., shall be gir.en by the seruice provider / Board to the buildings only after the production ol the completion / occupalion cerLificate. (v) trven after .issuance of completion certificate, deviation / vrolation if any contrary to the planning permission brought to the notice ol the aulhoriry immediate steps be taken by the said authority concerned, in accordance u,ith law, against [he builder / or,,,,ner / occupant; and the official, who is responsiblc for issuance of wror-rgful c-.mpietion / occupation certificate shall be proqeeded departmcntally furthwit h. (vi) No permission / licence to conduct any business / trade mlrsl bc givcn by any authorities including local bodies of States / Union Territories in any unauthorised building irrespective of it being residential or commercial building. (vii) The development must be in conformity with the zonal plan land usage. Any modilication to such zonal plan and usage must be taken by strictly following the rules in place land in consideration of the larger public interest and the impact on the environment".
