S.Sravanthi, Iearned Assistant Government pleader for Stamps and Registration and Sri Farhan Azatn Khan, learned Standing Counsel for the Telangana State Wakf Board appearing for the respondents and perused the material on record. With their consent, this writ petition is disposed of at the stage of admission itself.

Aggrieved by the action of the respondent No.2 in not receiving the document presented by the petitioner Y , SK'J W.P.No.3f ,: 9l of 2025 for the residential l-touse bearing H.No.30-445,30 on Plot No.30, in Sy.No.46 I, 462 and 463, to an extt:tl . of 200.00 Square Yards or 167.20 Square Meters, u'it I a plir-rth area of 1OO.OO Square Feet of ACC roof sitr:r ted at Old Sahlguda, Malkajgiri, within the limits of GIl\'IC, under Malkajgiri Circle and Mandal, Medchir -Malkajgiri District, the petitioner liled the present writ p' ition Learned Assistant Government Pleadr:r' lor Stamps

3. and Registration submits that the pcli ioner has approached this Court seeking registratiorl lf the said document without presenting it before the Registering Authority. If the petitioner presents the dor:rr nent before the Registering authority, the respondents u'rl receive the salne and fol1ow the procedure. If thc e are any objections, appropriate orders shall bc passed AS contemplated under Section 71 of the Reg I tration Act, 1908 (for short, 'the Act, 1908). The Section 71 of the Act, 1908, reads as follows: Reasons for refusal to register to be recorded.- (1) Every Sub Registrar refusing to register a document, excepL on the ground lhat rhe property to which it relates is not situated within his sub-district shall make an order of refusal and recorded his reasons for such order in his Book No.2, and endorse the words "registration refused" on the document; and, on application made by any person executing or claiming under the document, shall, without paymenl and unnecessary delay, give him a copy of the reasons so recorded. (2) No registering officer shall accept for registration a document so cndorsed unless and until, under the provisions hereinaiter contained, the documenl is directed to be registered.

In view of the above made submissions coupled with the provision under Section 71 of the Act, 19O8, this writ petition is disposed of directing the Registering Authority to receive, register ald release the subject I I document, subject to the petitioner complying with the provisions of the Act, 1908 as well as the Indian Stamp Act, 1899. It will be open to the Registering Authority to refuse the document presented before him, if he has any objection, by duly assigning reasons in support of such_ 4 SK,J W.P.No.3:l t9l of 2025 decision and communicate the said decis;: ln to the petitioner.
