Respondent : ORDER: This criminal petition is filed under Section 482 of Bharatiy;r Nagarik Suraksha Sanhita, 2023 by the petitione:r/Accused seeking anticipatory bail in connection with FIR No.1885 of 2025 of Cyber Crimes Police Station, Hyderabad District. The offences alleged against the petitioner are under Sections 67, 67A, 67B of Information Technologr Act, and , { I i t 2 Sections 294, 79 rlw.49 of Bharatiya Nyaya Sanhita, 2023 and Sections 8 rfw.7, 12 rfw.lL, 14 r/w.13, 17 r/w.16 of POCSO Act.
2. The facts of the case are that Sri R. Vinay.Kumar, PC- 30282, who was working at Cyber Crimes P.S, Hyderabad, submitted a complaint to his superior officer on 16. lO.2O25 at about 2O:OO hours stating that he had found videos related to child abuse posted on the YouTube channels Viral Hub and E96TV Entertainment (ViralH ub OO7 @E96TVE NTE RTAI N MENT) . The videos contained interviews with minors under 18 years. of age. During these interviews, the anchor deliberately posed obscene and sexually suggestive questions to the minors. The interaction led to an incident where two minors were induced to kiss each other. The content also inclucled obscene words and behavior directed at and involving the minors. The creators of the videos clearly exploited the minors to gain public attention, increase views/likes, and earn financial profit- The material was indecent, compromised the welfiare of the children, and diverted their minds inappropriately, while also sending a damaging message to the wider public. 3. Heerrd Sri K. Narender, learned counsel for the petitioner and Sri l).Arun Kumar, learned Additional Public Prosecutor appearing; for the respondent-State.
4. The: contention of learned counsel for the petitioner is that petitioner is innocent of the said offences and he is falsely implicaterl in this case. The petitioner is operating a You Tube channel emd other social media platforms under the name "Viral Hub OO7' and conducting interviews in appropriate manner and uploading; the videos with the due consent of tJre persons who are inten'iewed. There is no evidence to support the allegations against the petitioner and the inconsistencies or contradictions in staterrLent of victim. Petitioner undertakes to abide by any conditions that may be imposed by this Court and prayed to grant bail to the petitioner by allowing this petition.
5. On the other hand, learned Additional Public Prosecutor opposed bail stating that the allegations against the petitioner are seriotrs in nature. The petitiorre, i" continuously conducting interviewr; with children in an abusive and inappropriate manner and posting such videos on his. social media platforms which arr: objectionable and having bad influence on children as well as gr:neral public. Investigation is not yet completed and custodial interrogation of the petitioner is necessary to know the *n& 4 involvement of other accused, if any. If anticipatory bail is granted to the petitioner, it may hamper the investigation. As such, prayed this Court to dismiss this petition. 6- considering the submissions of both the counsel and examining the material on record, according to the prosecution petitioner herein is running a channel in You Ttrbe wherein the content concerns interview with minor under 18 years of age and during the said interview the anchor deliberately poses obscene and sexually suggestive questions to the minors. The interaction was observed to lead directly to an act where two minors were induced to kiss each other. The contention of petitioner is that he is no way connected with the said allegations and the parties who participated in the interview are not minors, that there is no complaint given by anybody in this case and the defacto complainant suo rnoto taken action basing on the video clips. The allegations seems to be serious against the petitioner that knowingly obscene.questions were suggested to minor contestants in an interview and according to the prosecution even after registration of case, petitioner is continuing the same. considering the severity of allegations and also the attitude of petitioner, this court is not inclined to grant bail to the petitioner and the-same is liable to be dismissed. 1 5 7 A<:cordingly, this criminal petition is dismissed.
