This writ petition is filed questioning the action of respondents issuing Lookout Circular (for short "LOC") No. 1/SIC(ACK)/LOC/2023- 16833, dated t4.1r.2023 issued by the 2"d respondent herein as being illegal, arbitlary and also violative of Articles 14, 16, i9 and 2l of tbe Constitution of India and seeking a consequential direction to respondents not to prevent the petitioner's son namely Ravi Kiran Dharmarajula who is staying at Abroad and Accused in F.l.R.No.179 ol 2023, dated O8.07.2O23 on the fiie of the Kothagudem III Town Police Station of Bhadradri Kothagudem District 2 (C.C.No.402 ol 2O24 on the lile of the Court of the II Additional Judicial Magistrate of First Class at Kothagudem) is likely to visit India at the behest of the sth respondent complaint forthwith.

The facts in brief as stated in the affidavit are that 5e respondent is the daughter in law of petitioner and marriage of petitioner's son with 5tt respondent was performed on 24.O4.2O19 and later both of them went to Australia, lead happy marital life and the Sft respondent due to some misunderstandings, returned to India on

06.11.2022 and later the son of petitioner requested the 5s respondent to accompany him to Australia but she refused as such his son left to Australia for the purpose of his employment.

Thereafter, Sth respondent lodged a complaint on O8.O7 .2023 before the 3rd respondent herein alleging dowry harassment and a case in Cr.No.1l9 of 2023 was registered on the petitioner and his family members were also roped into the said case. Later, 3rcl respondent filed charge sheet before the Court of II Additional Chief Judicial Magistrate of First Class at Kothagudem vide C.C.No.402 of 2024 showing his son D. Ravi Kiran (A-1) as absconding as he is in Australia on account of his employment. Petitioner now submits that his son/A- 1 is likely to visit India for settlement of the case but, NBW was pending against his son and he is apprehending that 2nd and 4th respondents at the behest of Sth respondent may obstruct/ prevent his son at the Airport, and in order to avoid unnecessary torture and mental harassment, petitioner has filed the present writ petition. A memo has been filed by the learned counsel for the petitioner in which a copy of order passed in Crl.P.No.87lO of 2024 is placed wherein this Court has allowed the Criminal Petition and criminal proceedings against the petitioners/A-2 and A-3 in C.C.No.402 of 2024 on the file of the Court of the II Additional Judicial Magistrate of First Class at Kothagudem are quashed. Learned counsel for the petitioner further submits that A-2 and A-3 in the said crime are none other than the petitioner herein and his wife. It is lurther submitted that now the C.C.No.4O2 of 2024 on the hle of the Court of the II Additional Judicial Magistrate oi First Class at Kothagudem is posted on 04.02.2026 and the petitioner would like to represent his case on the next date of hearing.

5. In the writ petition material papers, a copy of the LOC Proceedings dated 14.11.2023 issued by the Bureau of Immigration, (Ministry of Home Affairs), Government of India was placed, wherein LOC was opened at the request of the 4fr respondent.

6. In that view of the matter, this writ petition is disposed of suspending the LOC dated 14.11.2023 opened by the 2"d respondent against the son of the petitioner i.e., rRavikiran Dharmarajula (A-1 in Crime No. 1 19 of 2023 of Kothagudem III Torvn Police Station) from

25.01-2026 to 15.02.2026. It is made clear that the LOC issued against the petitioner's son is suspended from 25.01.2 026 to

15.02.2026 subject to the condition that the petitioner,s son shal1 surrender his passport before the trial Court/Court of the II Additional 4 Judicial Magistrate of First Class at Kothagudem immediately after entering India and for further travel from India the petitioner's son has to take permission from the trial Court/Court of the II Additional Judicial Magistrate of First Class at Kothagudem.
