Lear-ned Senior counsel apoearing for the p:titioner would submit thrlt the petitioner had succeeded in w.p.No .31434 of 2olz, wherein, this court, by an order, dated 2l.o1.2o2il, while setting asice the earlier endorsement bearing Lr.No.E2/ 19z82016, dated 07.06.20 lti directed the District Collector-responderrt No.2 therein to reconsider the case of the petitioner for irssignment of Government land in terms of the policy of the (iovernment in G.O.Ms.No.743, dated 3O.O4.1963 in Sy.No.132 o: in Sy.No.31 situated at Govindrajpally. Learned Senior Counsel wiuld further submit that, since no action is being taken on regular.pursuance of the petitioner herein, the petitioner had made re lresentations, dated 25.09.2023, L9.o!.2024, L2.o2.2o24 and 2r.o5.2o24 before respondent No.2. Learned Senior counsel would firther submit that, without considering the aforesaid representations, respondent .A[Lz had issued the impugned endorsemr:nt bearing 3 EW, J Wp_39393 2025 No.E I I LSOB I 2018, dated t3.O8.2O24, stating that respondent No.2, while referring to the order passed by this Court in W.P.No.3 1434 of 2017, had informed the petitioner that clarification is being sought from the Government due to inconsistency in G.O.Ms.No.743, dated 30.04.1963 by addressing letters uide Lr.No.E2 12552/2O11, dated O5.L2.2O17, O3.Og.2}lg,
25.IL.2O19 and 12.07.2024. Learned Senior Counsel would further submit that the petitioner'had succeeded in the earlier writ petition, wherein this Court directed respondent No.2 to allot the Government land in terms of G.O.Ms.No.743, dated 3O.O4.1963 and the interpretation of the said G.O. is quite clear that the persons, who have retired from Army/Navy, are entitled to make an application for assignment of land, which is being routed through the Secretary, State Sold.iers, Sailors and Airmen's Board and the petitioner also falls under the Same category and despite the said fact, respondent No.2 neither considered the request of the petitioner nor rejected the same by assigning valid reasons in the order of this Court in W.P.No.3]434 of 2017, thereby putting the petitioner fad.e in limbo. Therefore, learned Senior Counsel prays this Court to pass appropriate orders directing the respondent authorities to consider the case of the petitioner for assignment of the land in terms of G.O.Ms.No.7453, dated 3O.O4.1963. 4 EVV, J Wp_39393 2025 -'P 4' Lr-'s-r'"'€d Assistant Government Pleader for Assignment would submit that it is the case of the petitioner that respondent No.2, instead of consiciering the petitioner's request, set:k clarification in thu light of acute shortage of the land in the District as the availabk: extent of Government land is required frlr various public purpose:i like establishment of Integrated Resilential Schools, sub-centres, Anganwadi centres, p.iblic parks, plrrygrounds, Solid waste M-anagement parks etc. and except such land, which is being ear marked for the aforesaid pubric purr)oses, no other rracant Government land is availablf In these circurnstances, he would subrnit that necessary communication was addressed to the Governmt:nt seeking certain clarifications and ;ince the said clarilicatir>n has not been received by r-espondent No.2 from the Governme nt, the case of the petitioner is kept pending and as and when such clarif-rcation is received respondent No.2 would act upon the petitioner's representations and pass ner:edsary orders. He would further submit that, without waiting, the petitioner has rushed to -his Court at a premature stage. 5 Having heard the learned'senior counsel for the petitioner and learned Assistant Government pleader for.
