3. The u,hole issue arose out of the seizurc u,hich $'as scized by the second respondcnt upon the petitioner travelling lrom Abu Dhabi to Hl,dcrabad bi'utihad Ainvays Flight 8Y358 on I l.l1.2025. It has been contended by leamed counsel lor the petitioner that the petitioner at this juncture is ready to pay whatcver the custom duty is assessed with and penalty and other charges that shall be imposed by the customs authorities which could entail the petitiDner fbr the release o{ the goods.

Learned Senior Standing Counsel for respondent No.3, on the other hand, contends that since the goods were seized only on .\. , l2.l1.2025, the proceedings under the Customs Act, 1962 (for short "the Act") have to be drawn strictly in accordance with the provisions spelt out under the Act. The petitioner submits that he has approached the authoritics by rva1, o[ represcntation dated 21.11.2025 asking thern to expcdite thc procecdings by asscssing rvhatever is the \ customs duty, penalty and other chargcs. which the petitioner would be required to pay for the release of thc said goods. I{owever, the grievance of the petitioner is that there has becn no further progress since then. Learned Standing Counscl submits that it is too early at this .iuncture to say that therc is no progress in the proceedings. 'I'he provisions of law have to be drarvn in a procedural manner as stipulated under the Act and which takes its own time. Leamed Standing Counsel further also highlighted the aspect that if at all if lor any reason notice under Section 124 has not bcen issued rvithin a period of six months, the petitioner would be automatically get the benefit and shall be entitled for release ofthe said goods.

6. Considering the submissions made on the part of counsel appearing on either side. we do not intend to keep the writ petition pending any further. I 4 7 .
