Learned counsel for the petitioner submitted that the petitioner is a old aged widow and hails from economically weaker back ground and she cannot afford a huge deposit of Rs.3 Lakhs for return of her own Mangalsutra and that the learned Magistrate failed to consider the weak financial position of the petitioner, hence she prayed for allowing the Criminal Revision as well as the above lnterlocutory Application.

4. Learned Additional Public Prosecutor reported no objection for returning the property i.e Gold Bead Chain/Mangalsutra and sought for furnishing of personal bond by the petitioner for a reasonable amount and left it to the discretion of the Court to pass appropriate orders.

Having heard both the learned counsel and on perusal of the material available on record, the ownership of the property is not in dispute and it is the case of the petitioner that she cannot afford a huge deposit of Rs 3 Lakhs for her own Mangalsutra. Therefore, considering the facts and circumstances of the case and poor financial condition of the petitioner, this Court is of the considered opinion that the condition imposed by the trial Court in respect of furnishing personal bond for a sum of Rs.3 Lakhs with one surety can be modified to furnishing personal bond for a sum of Rs.5,000.00 with one surety for release of property i.e. Gold Bead Chain/Mangalsutra.

6. With the above observations, this Criminal Revision Case as well as lnterlocutory Application are disposed of. Pending miscellaneous applications, if any, shall stand closed SD/. MOHD.
