Learned counsel for the petitioner further submits that on the earlier occzrsion, this court passed an order dated 06.1 2,023 in W.P.No.33090 of 2023, directing the respondent authorities to register the documr:nts presented/pending before them with regard to the same survc)y number, without reference to the Notification datecl

26.O9.2O13 The subject land in the present Writ Petition also pertains to the s?rr,€ survey number and also a similar letter issued b.v respondent No.3 in Lr.No.El l33gr /2024 dated 03.10.2024. In view of the same, the impugned Refusal order No.451 of 2o2s dated 29.1o.2025 issued by respondent No.3 is illegal and arbitrary. 4- Learne,d counsel for the petitioner further submits that there is a checkered ristory of Sy.No.44, situated at Maktha Mahabubper Village, Seri ingampall.v Mandal, Ranga Reddy District. with regard to the entries of Sy.No.44 in revenue records, the orders passed by the chief comn:issioner of Land Administration in File No.p3/45612013 dated 29.05.2014 was earlier set aside by this Court in W.p.N o.23ST4 of 2oL4 uict.e order dated rr.or.2orz and granted riberty to the authorities Lo take actiorr as per the order passed by the Joint I 3 Collector uide No.E I /7306 / 1999 on 19.01 .20L3 and the Joint Collector uide its order dated 19.01.2013 directed the Deputy Collector and Tahsildar, Serilingampally Mandal, Ranga Reddy District, to examine the records in respect of the subject lands and if he found any fabricated material produced relating to fraud for issuance of supplementary Sethwar and for obtaining correction of revenue records, to file comprehensive Civil Suit for declaration of title and for recovery of possession in favour of Government in accordance with law. Aggrieved by the orders in W.P.No.23574 of 2014 dated

17.01.2017, the respondent authorities have filed W.A.No.1499 of 2Ol8 and the same was dismissed by the Division Bench of this Court on 25.L1.2O24. In spite of the same, the respondents are again showing the suit schedule property in the prohibited list and the same is contrary to the orders of this Court.

Learned counsel for the petitioner further submits that this Court passed orders in W.P.No.3309O of 2023 dated 06.12.2023 and directed the registering authorities to register the lands without reference to the notification dated 26.09.2013. The subject land in the present Writ Petition also pertains to same survey number and also the respondent No.3 issued Lr.No.E L13387 /2024 dated 03.10.2024 before the dismissal of W.A.No.l4,99 of 2O1B dated 25.11.2C)24 and, basing on the letter dated 03.10.2024 issued by respondent No.3, the -/, .f 4 respondenl' No.S issued impugned Refusal Order No.45 t of 2O2S dated 29.10.2o2i; and the same is riable to be set aside. 6' on the other hand, learned Assistant Government pleader for stamps anrl Registration did not dispute the disposai of w.p.No.33090 of 2023 dzrted 06.12.2023, orders in w.p.No.z 3sr4 of 2or4 dated 17 'ol'2or7 and w.A.No.1 499 of 2or' dated 2s.rr.2024 and requested to pass appropriate orders. 7' Recor<ling the above submissions made by learned counser on either side and r.vithout expressing any opinion on the merits of the case, tlris writ petition is disposed of directing the Registering Authority t') receive, register and release the subject document presented by the petitioner, without reference to the letter dated 03.1o.2024 issued by respondent No.3 and without reference to the impugned Refusar order No.45t of 2025 dated 2g.r0.2o25 issued by respondent No.5, subject to the petitioner comprying with the provisions of the Registration Act, 1g0g and Indian stamp Act, 1Bgg. It will be open to the Registering Authority to refuse the document presented br:fore him, if he has any objection, by dury assigning reasons in support of such decision and communicate the said decision to the petitioner thereon I t: 5

8. It is also made clear that this order does not preclude the Government/District Collector to take appropriate steps as warranted by law and to assert its title. If any proceedings/suit/appeal pending beti,veen the executants of the document/Government or any other interested party, the registration of the document r,vill be subject to the resuit of that proceedings/suit/appeal.

9. Accordingly, this Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition, shall sta-nd closed SD/-l\i[.
