2. The respondents herein/plaintiffs instituted the suit vide O.S.No.34 of 2021 on the file of Principal Junior Civil Judge, at Armoor, against the petitioners herein/defendants seeking partition and separate possession of suit schedule properties. Along with the suit, the plaintiffs liled LA.No.74 of 2O2l seeking to grant temporary injunction restraining the defendants not to alienate or enter into any kind- cf, agreement with third parties in respect of schedule 2 ..i properties .A' to 'L', till disposal of the suit. The trial court vide order dated 10.11 .2023 allowed the said I.A, granting temporary injunction in favour of the plaintiffs and against the defendants by restraining them from alienating the schedule properties in favour of third parties, till the disposal of suit. Aggrieved by the same, defendants filed c.M.A.No.S of 2023 on the file of the learned senior civil Judge at Armoor and the learned Appellate Court, after thorough examination of the documents liled along with the appeal, dismissed the appeal vide order dated 22.07.2025 confirming the orders of the trial court. challenging the same, the present revision is frled by the defendants.
3. Admittedly, the suit is for partition and separate possession of suit schedule properties. It is the case of the petitioners/defendants that the suit schedule properties are self-acquired properties but not joint family properties and as such, the plaintiffs are not entitled for any share in the suit schedule properties.'The issues raised herein can be decided only after full-fledged trial. The Courts below have rightly granted interim order protecting the interest of the parties. There is no illegality or irregularity in the impugned orders passed by the courts below warranting interference by this Court under Article 227 of the Constitution of India. 3 4- At this stage, learned counsel for the petitioners requested that the trial court be directed to dispose of the suit vide o.s.N o-34 of 2O2L within a fixed time frame.
5. In view of the above submission and considering the nature of the dispute, it is appropriate to direct the trial court to conclude the trial expeditiously.
6. Accordingly, this civil Revision petition is disposed of directing the learned Principal Junior civil Judge, at Armoor, Nizamabad District, to dispose of the suit in o.s.No.34 of 2o2l preferably within a period of one year from the date of receipt of a copy of this order.
