LAKSHMAN WRIT PETITION No.236 of 2o25 ORDER: Heard learned counsel for the petitioner, learned Assistant Government pleader for Municipal Administration and Urban Development appearing for respondent No.1, Sri V.Narsimha Goud, learned Standing Counsel appear-ing for respond.ent Nos.2, 3 & 5 and Ms.Sravanthi, learned Assistant Government pleader for Revenue appearing for respondent Nos.4 and 6. perused the record.
2. Petitioner is claiming that pursuant to the notification dated 06.O2.2023 issued by respondent No.3, he has participated in the e-auction Oi.03.2O23 in respect of sale of stray bits of plot No.2, admeasuring 413 square yards, in Sy.No.17 (p2), situated at Bairagiuda Village, Gandipet Mandal. Ranga Reddy District. Petitioner paid total sale consideration of Rs. 1,44,55,0OO/- in respecl of 413 Square yards on KL,J w.P.No.236 of 2O25 different dates. Respondent No.3 has issued pre-final allotment letter on 20.1O.2023. Final allotment letter was not issued.
3. During the physical measurement of the subject plot, it was found that area of the said plot is only 351 Sq.yds, but not 413 Sq.yds as notified. Therefore, the petitioner submitted severa-i oral representations inciuding e-maii, dated 25.09.2023 requesting respondent No.3 to refund an amount of Rs.22,7O,0OO/- @ 35o/. per square yard in respect of deficit area of 62 square yards. Despite receiving and acknowledging the said e-mail, respondent No.3 did not act upon the same. Aggrieved by the said inaction of respondent No.3, petitioner filed the present writ petition.
4. Sri V. Narsimha Goud, learned Standing Counsel appearing for respondent No.3, on instructions, would submit that respondent No.3 vide letters, dated
15.02.2024 and 15.11.2024 requested respondent No.4 II I(I,,J lv.P.No.236 of 202s to conduct joint survey of the subject property and submit detailed report with remarks on the variations in respect of the extent of the above stray bit (1and parcel) aiong with location sketch with boundaries. If respondent No.4 conducts survey and demarcate the subject property, respondent No.3 will consider the same and a-lso representation, dated 29.O2.2O24, submitted by the petitioner.
5. Learned Assistant Government Pleader for Revemre, on instructions, would submit that respondent Nos.4 and 6 will consider the letters, dated 15.O2.2024 and
15.11.2024 of respondent No.3 and conduct survey rn'ith regard to the variations of the extent of the subject property and demarcate the same arrd submit a report to respondent No.3. \ In the light of the said submissions, this Writ 6. 15.02.2024 and requested by propertv, extent of the subject respondent No.3 vide his letters, dated 15.L7.2024, and submi.t a report to responclent no.3 along with the jocation sketch within two (2) weeks from the date of receipt of a copy of this order. Thereafter, respondent No.3 shall consider the same. If respondent Nos.3 to 6 are not inclined to accept the request of petitioner, they shall assign reasons, pass a reasoned order and communicate a copy of the said order to the petitioner. They shall complete the said exercise within a period of four (4) weeks from the date of receipt of report from respondent No.4. There shall be no order as to costs.
