This Petition coming on for hearing, upon perusing the Memorandum of Grounds of Criminal Petition and upon hearing the arguments of Sri Ajay Kulkarni, Advocate for the Petitioner and the Additional Public Prosecutor on behalf of the Respondent No 2 and of Sri Mohammed Hussian, Advocate for the Respondent No. 1. JUSTICE JUVVADI SRIDEVI I.A.Nos.2 and 3 of 2025 in/and C RIMINAL PETITION No.40 of 2025 COMMON ORDER: This Criminal Petition is filed under Section 528 oi BNSS by the petitioners/accused Nos. I and 2 to quash the proceedings against them in P.R.C.No.455 of 2024 on the file of XVI Chief Judicial Magistrate, Hyderabad, registered for the offence punishable under Section 109 r/w 3(5) of BNS.

It is submitted by learned counsel appearing for the petitioners as well as the respondent No.2, that during pendency of the present Criminal Petition, the parties havc 1 compromised the matter and accordingly, I.A.Nos.2 and 3 ol 2025 have been filed to record the compromise between them and to compound the offences.
3. Vide order dated 07.01.2025, this Court directed the parties along with their respective counsel to appear before the Secretary, High Court Legal Services Committee, High Court for the State of Telangana, Hyderabad, for identification and to submit a report. 2
4. Pursuarrt 1o thc above said direction issued by this Court, the parties have appeared and the Secretary, High Court Legal Services Conrmittee, has identified the parties and submitted a repoft, dated 09.01 .2025 and the same is placed on record.
5. In vierv of the above, I.A.Nos.2 and 3 of 2025 are allowed. Consequently, this Criminal Petition is allowed and the procecdings against the petitioners/accused Nos"l and 2 in P.R.C.No.455 of 2024 on the file of XVI Chief Judicial Magistrate, Flyderabad, are hereby quashed. It is submitted that the respondent No.1 herein filed a complaint against petitioner before Shalibanda Police Station on 29-07-2024 and based on the said complaint the police have registered as FIR and charge sheet vide p.R.c.No. 45s of 2024 on the fire of )0/I chief Judiciar Magistrate for the offence punishabre under sections 109 R/w 3 (5 ) of B.N.S against the accused.
2. It is submitted rhat I have lodged complaint in FIR vide Crime No. 103 of 2024 before Shalibanda police Station and police ' have filed charge sheet vide pRC No. 455 of 2024 before XVI clM against the accused No. 1 and 2 herein as they have.beat me and tried to stab me, based cn the said complaint the police have r&istered the above said compraint against the accused herein and the same is hereunder chalhnge.
3. It is submitted that clue to timely intervention of elders and well wishers of both the parties herein, have seftled the dispute between them outside of th: court and decided to compromise the matter taking into consideration oF their family relation and background. That the respondent no.1 herein came forward to withdraw the complaint lodged by him against the petitioner and to that affect, he has also executed an affidavit expressing his willingness to not press the complaint against the petitioner.
4. It is submitted that the dispute between the parties is settled outside the court and to that effect, the parties herein have executed affidavits and loint Memo. That considering the above facts and circumstances this Hon,ble court may be pleased to quash the proceedings in p.R.C. No.455 of 2024, on the file of )0/i Chief l) r' Judicial Magistrate, Hyderabad, in view of compromise between the ) parties, otherwise the petitioner will be put to serious loss and hardship which cannot be cornpensated in any manner. It is therefore prayed that this Hon'ble Court may be pleased to record the compromise statement and quash the P.R.c. No.455 of 2024, on the file of XVI Chief Judicial Magistrate, Hyderabad, in view of the compromise between the parties, in the interest of justice and pass such other order or orders may deem fit and proper in the circumstances of the case.
