2. Heard Sri Yadaiah Boddupally, learned counsel appearing for the petitioner and Sri L. Ravinder, Iearned Assistant Government Pleader for Revenue, for respondents Nos.1 to 4 and perused the record. a 2

Learned counsel appearing for the pet:t ioner would submit that the Government of Telalgana l-Ias issued G.O.Ms.No. 1, dated 26.O7 .2014 introducing Lrr rd Purchase Scheme Purchasing and assigning of Acs.3 ( 0 guntas of agricultural land to the ..voken of "Bhoomil:-ri Nirupeda Dalita Vyavasaya Aadharitha Kutumbalu" rnder Land Purchase Scheme for Schedule Caste Comrr unities and suggested certain reforms for better imple r': .entation of scheme duly announcing that the Land PurcL ase Scheme is flagship programme of the Government thr rughout the State. Since then, the government of 'l:langana 1S implementing the scheme by duly rr,r eiving the applications from the eligible landless p() )r: persons. Respondent No.2 has to identify laldless Sche< uled Castes households by verifying all the land records md identify the poorest of the poor among them as per - IRP Survey data which will be validated and finalize < . As per G.O.Ms.No. 1, dated 26.O7.2014 the wife of S(: household shall be given patta by the district administr; tion for the above scheme and the essential requirement ur der the G.O 3 is that the beneficiar5z on whose name the patta is to be granted should be a SC person. 4 . The wife of the petitioner has submitted an application in the yex, 2074 along with the others for allotment of the agricultural land under the said scheme. Respondent No.2 issued allotment orders to some landless poor persons including respondent No.5. But respondent No.S does not belong to Schedule Caste Community she belongs to BC-Mangali. Upon knowing the said fact, the petitioner submitted representations dated 30.06.2O25 and 2I .O8.2O25 to the respondent-authorities and requested them to conduct enquiry and take appropriate legal action against respondent No.5 for misleading the authorities and also requested them to cancel the allotment granted in favour of respondent No.5.

Basing upon the representations submitted by the petitioner, respondent No.4/Tahsildar directed Mandal Girdawar to conduct detailed enquiry and thereafter respondent No.4 has issued letter uide Rc.No.B/482 l2O2S, !-I \ \I 4 dated 14.08.2O25 stating that respondent N<.5 belonging to BC-Manga-li Community and they have all:.t.ed the land to an extent of Ac.O.12 guntas in Sy.No.93/'l and Ac.2.28 guntas Sy.No.9a/4, total to an extcnl of Acs.3.00 guntas, situated at Chinnaguduru. Despite t re same, the respondent-authorities are not taking anJ action for cancellation of allotment. Hence, the present \ /rit petition

Learned Assistant Government Pleaclel for Revenue would submit that upon receiving the rr'1 resentations submitted by the petitioner, the responder t-authorities had made detailed enquiry and it is found tl-ra: respondent No.S belongs to BC-Mangala Community an I she is not eligible for the said scheme. But, the respondent- authorities are not vested r'vith the powers of c:r .ncellation of any allotment. Hence, seeks to pass appropria :e orders.

Having considered the rival submissionr; made by' the a parties, and without making any observat ons on the merits and demerits of the case, this Cor rt deems it appropriate to dispose of the present writ petition by 5 granting liberty to the petitioner to work out the remedies as available under the law.
