3. During the course of hearing, learned counsel for the parties, fairly submitted that impugned arrear notice and personal hearing notice were issued on O4.1O.2O24 and O8.1I.2O24 respectively. By personal hearing notice issued on O8. 11.2024 (Annexure-P5), the petitioner was directed to attend the personal hearing on 18. 11.2024. However, before that, by way of notice issued orr 08.11.2024 (Annexure-P7), the petitioner's propert5z was directed to be attached. Learned counsel for the parties, during the course of hearing, fairly admitted that this attachment notice dated
08.11.2024, which was passed before the date of personal hearing, may be set aside and matter may be remanded to the competent/Proper Offrcer to take a fresh decision in accordance with law. The petitioner agreed to appear before the said ofhcer on

4. In view of consensus arrived at, the impugned notice dated Oa.lt.2}24 (Annexure-P7) is set aside. The petitioner shal1 appear before the authority who has issued the notice (Annexure-P5) dated
08.11.2024 onO9.OI.2O25 at 11:0O A.M. The said authority, after hearing the petitioner, shall take a fresh decision in accordance with law. The personal hearing shall be given to the petitioner for the purpose for which notice dated 08.11.2024 was issued. It is made clear that no fresh notice will be required to be issued to the petitioner arld date fixed today shall be treated to be a notice to the petitioner. 5 Accordingly, the Writ Petition is disposed of without expressing any opinion on the merits of the case.
