2. Heard Sri Muppu Ravinder Reddy, learned counsel for petitioner ald smt B,Kavitha Yadav, learned standing counsel for Central Government, for respondent Nos.1 and 2.'Perused the record.
3. Learned counsel for petitioner submits that mere arraignment of the petitioner in a criminal case cannot be a ground for denial of 2 NBKJ wP_359s8 2025 passport, He relies on the judgment of this court in w.p.No.31316 of 2O2l,,Cated 2T .LO.2O2S.
4. l,earned Standing counsel for the respondents submits that criminal oase is pending against the petitioner uid.ec.c.No. LTZ4 of 2022 bef<lre the learned XXIV Additional Metropolitan Magistrate, Ranga Reddy District, at Hayathnagar. It is submitted that the respondent authorities would consider the petitioner's application for a period of one year only, if he obtains permission to travel abroad from the court where the criminal case is pending against him. 5- Be that as it ffi&y, considering the judgment of the coordinate Bench of l:his court in w.p.No.31316 of 2o2s, dated 2T.Lo.2o2s, and [he purpose for which the passport is being requested by the petitioner, this court directs the respondent No.2 to issue the passport tc, the petitioner on the following conditions: i) The petitioner herein shall submit an undertaking arong with an aflidavit ia'c.c.No.t774 of 2022 before the learnul :orri, Additio:nal Metropolitan Magistrate, Ranga Reddy District, at Ha5rathrragar., stating that he shall noi leave rndia during pendenr:y of the said c.c., without permission of the court ani that he shar cooperate with trial coutt in concluding the proceedings in the said crime; :iif on liliag such aa uadertar.ing as well as aflidavit, the trial corurt shall issue a certitied copy oi the same within do (2! weeks tlrerefrom; i.iil rhe petitioner herein sha[ submit an apptication afresh eilong with certified copy of this order as well as the aforesairl undertaking_before thl nassport Oflicer / Authority conc€lllrsd for issuing the passpott; 3 NBK,J wP_35958_2025 iv! On filing such an application, the Passport Officer/ Authority shall consider the same afresh in the tight of the observations made by this Court herein as well as the contents of the undertaking given by the petitioner for issuing the passport, in accordance wlth law, within three (03) weeks from the date of said application; vf Respondent No.2 shall consider the Passport Rules, L967 while considering the application for renewing of the passpgrt to the petitioner; vi) The competent authority shall ppgcify the permission period of one year for the petitioner to renew the passport for travelling abroad, and also. obtain appropriate undertaking from the petitioner stating that the petitioner shall not overstay the permitted period and shall surrender the passport upon return to India. vii| Any other condition as deemed appropriate by the , trjhl Court. l. f;..'
