BHASKAR REDDY WRIT ON No.364 of2o25 ORDER: This Writ Petition is filed praying this Court to declare the action of respondent authorities in not taking steps to release the entire land admeasuring Acs.2400.00 guntas in Sy.No.7 situated at Mansoorabad Village, Saroornagar Mandal, Ranga Reddy District, which was kept under the custody of the Government as care taker by the original pattadar Smt.Haneefa Bee, W/o. Burhanuddin and the said land was made into plots to an extent of 100 square yards to each petitioner. and the same is in occupation of the petitioner as illegal, arbitrary, unconstitutional and violative of Articles 2L and 300_A of the Constitution of India and for other appropriate reliefs.

2. karned counsel for the petitioners submitted that the petitioners are the owners of various extents of plots forming part of Sy.No.7 situated at Mansoorabad Village, Saroornagar Mandal, Ranga Reddy District. It is further submitted that the pattadar of the land Smt.Haneefa Bee, W/o. Burhanuddin kept the said land under the custody of the Government as care taker. It is further submitted that the name of the original pattadar was recorded in all the revenue records, which is Z CVBR, J wp_364_2025 evident from Munthakab and Sethwar No.7262/1352 Fasli, therefore, he prays to direct the respondents to release the subject property from the custody of the Government.

3. Considered the submissions of the learned counsel for tlre respective parties and with their consent this writ petition is disposed of at the admission stage.

Sri Etooru Pornachander Rao, learned Government Pieader for Forest has submitted that earlier some of the plot owners have filed writ petition and this Court, while disposing of the W.P.No.26934 of 2018 and batch, relegated the petitioners therein to approach the competent Court to establish their rights over the property, but without pursuing the said remedy, another writ petition also hled uide W.P.No.22l of 2024 before this Court for release of the property from the alleged custody of the Govemment. By an order, dated O 1.05.2024 this Court dismissed ttre said writ petition arrd aggrieved by the same W.A.No.1342 of 2024 was filed and this Court dismiss€d said appeal ui& judgment, dated 29.11.2024. The sarne is not disputed by the learned counsel for the petitioners.

In view of the above submissions and as it is stated by the learned counsel for tlle respective parties that the issue raised J CVBR, J wp_364_2025 in this writ petition is squarely covered by the orders passed by this Court in W.A.No. 1342 ot 2024, this Court, following the said judgment, dismissed this Writ petition, giving liberty to the petitioners to go before the appropriate civil Court as directed by ttris Court in W.A.No. 1342 of 2024, dated 29.1t.2024.
