THE HON’BLE Ms. JUSTICE G. ROHINI WRIT PETITION No. 11527 OF 2010 ORDER : The petitioners herein claims to be the absolute owners of the land covered by survey Nos.187 and 190 admeasuring Ac. 5-20 guntas situated at Allamthota Bavi, Begampet village, Balanagar Mandal, Ranga Reddy District. Alleging that the 6th respondent has encroached upon the public CC road and started illegal constructions, the petitioners made detailed representation dated 04.05.2010 before the respondents 1 to 5 herein. Aggrieved by the inaction on the part of the respondents 1 to 5 in restraining the 6th respondent from proceeding with the illegal constructions, the present writ petition has been filed. Heard the learned counsel for both the parties. The material available on record shows that the representation made by the petitioners was received in the office of the respondents 1 to 5 on 04.05.2010. In the circumstances, they are bound to make enquiry into the allegations made by the petitioners and take the appropriate action in accordance with law. Accordingly, without expressing any opinion as to the correctness of the allegations made by the petitioners, the Writ Petition is disposed of with a direction to the respondents 1 to 5 to consider the representation of the petitioners dated 04.05.2010 and pass appropriate orders in accordance with law after giving an opportunity to the 6th respondent to rebut the allegations. Such exercise shall be completed as expeditiously as possible preferably within a period of four (4) weeks from the date of receipt of this order. No costs. G. ROHINI, J Date: 27.07.2010 _____________
