Civil Re,vision Petition No.42 18 of 2024 is frled by the petitioner under Article 227 ol the Constitution of India aggrieved brr the Docket Order dated Oq'O9'2O'24 in I.A.No.735 of 2024 in O-S-No.348 of 2OO2 passed by the IV Additional Senior Civil Judge, Ranga Reddy District, zrt L'B' Nagar; and Civil Revision Petition No'4221 oI'2024 is filed by the petitioner under Articl e 227 of the Constitul.ion of Indlia Aggrier,'ed by the Docket Order dated O2'O9'2O24 in I.A.No.710 oll 2024 in O.S.No.348 of 2OO2 passed by the IV Additional Senior Civil Judge, Ranga Reddy District, ra't L'B' Nagar (for short, the impugned orders').

3. Heard. Mr. P. Maheswar, learned counsel appearing on behalf ,:f Mr. Abhinav Krishna Uppzrluri, learned counsel for the petitioners in both the Revisions' 21222 P5K,J <fP_4218&4221_2024

4. For convenience, the facts in Civil Revision Petition No.422l of 2024 are discussed herein.

5. Vide the impugned order, dated O2.O9.2O24, the Trial Court has rejected the I.A.No.71O of 2024 in O.S.No.348 of 2OO2, which was filed by the petitioner under Order I Rule 10(2) read with Section 151 of Civil Procedure Code, 1908, seeking impleadment as Defendant No.29 in the above suit.

6. At the threshold this Court is not inclined to entertain the Revision for the simple reason that ttre above suit, viz., O.S.No.348 of 2OO2 (which was frled by the respondent Nos. I to 4 herein under Section 26 read with Order VII Rule 1 of Civil Procedure Code, 1908) is of ttre year 2OO2 and with a prayer seeking for injunrtion simplicitor. The said suit has reached its fag end as the suit was posted for lina-l arguments of respondents / defendants herein. It is at this stage that the petitioner herein has filed the above I.A. seeking for impleadment in the above suit.

Perusal of the record would go to show that the petitioner herein herself claims to be a purchaser of part of the suit schedule property way back in the year 2OO4, 3 P5K,J cfP _4218&4221_2024 which was subsequent to hling of the above suit by the respondentsr / defendants, i.e., in the year 2002.

8. Firstly, this Court is of the considered view that the instant case is hit by the principle of cloctrine of lis pendens; and secondly, it cannot be presttmed that the petitioner herein had purchased the sulrject property without being aware of pendency of the above suit. Further, nothing prevented the petitioner herein to move an appropnate petition at arr appropriate time w-ithin a reasonable period of time. The petitioner, for the best reasons known to her, sat at the fence and watched the proceedings to reach at its fag end; and therea-fter, filed the present 1.A., i1z.,I.A.No.71O of 2024 in O.S.No.348 of 2OO2, seeking impleadment as Defendant No.29 in rhe above suit.

9. For all the aforesaid reasons, this Court is of the view that there is no illegalit5r committed by the Trial Court in passing the impugned order. However, given the fa.ct that the Trial Court has dismissed the above I.A. which was hled by the petitioner herein seeking impleadment in the above suit, the same would not preclude the petitioner from availin.g other legal remedies available to her under law. 10. Accordingly, Civil Revision Petition No.422l of 2024 stands disposed of. As a consequence, Civil Revision Petition No.4218 of 2024 also stands disposed of on similar lines. No costs.
