RAVINDER, AGp FOFI REVENUE The Court made the following: ORDER THE HONOURABLE SRI JUSTICE E.V.VENUGOPAL WRIT PETITION No.35522 of 2o.25 ORDER: This writ petition is liled declaring the action of the respondents in not considering the application for Appeals on DemarcaLion, dated O8.OL.2O25 seeking for survey of lald and demarcation of boundaries in respect of the larrd admeasuring Ac.O.39 guntas 1n Sy.No.24l lA/2/2 and Ac.O.Ol guntas 1n Sy.No.242, situated at Kandawada Village, Chevella Mandal, Ranga Reddy District, as illegal, arbitrary and violative of the Article 3OO-A of the Constitution of India and consequently, prayed for other appropriate reliefs.
2. Heard Mr.Zabi Ur Rahman Khan, learned counsel for the petitioner and Sri L. Ravinder, learned Assistant Government Pleader for Revenue appearing for the respondents and with their consent, this writ petition is being taken up for disposal at the admission stage.

Learned counsel for the petitioner would submit that tl-e petitioner is the owner and possessor of the land * .. ^-*1 2 EVV, J Wp 35522 202-s - admeasuring Ac.0.39 guntas 1n Sy.No.24 A/212 and Ac.0.O 1 guntas ln Sy.No.242, situated at Kandawada Village, Chevella Mandal, Ranga Reddy Dis rict, having purchased the same through registered sale reed bearing document No.3797 of 2015, dated 16.06.2015. Learned counsel for the petitioner would further subrri . that acting on the F-Line application, dated 28.12.2027, the Mandal Surveyor, Chevella, had conducted the sur! ry of entire extent of Iand Acs. 17.13 guntas in Sy.No.21 1 uide Fiie No.MS/237 1 l2O2l and prepared a report or f,1.11.2022. Thereafter, the petitioner made a request for sr rvey of land and demarcation of boundaries and when here is no response, the petitioner filed an application frr Appeals on Demarcation, dated 08.OI.2O25. The grie,,r rtce of the petitioner is that, even after receipt of the saic application the respondent authorities did not conduct su wey ald fix the boundaries. Learned counsel for the pet t oner would further submit that in terms of the circulars is;ued bv the Commissioner, Survey, Settlements and Lan<l I lecords, the respondents are bound to consider the applir:, .tion within 3 EVV, J Wp,35522 _2025 45 days from the date of the application after collecting necessary charges.
4. l,earned Assistant Government Pleader for Revenue appearing for the respondents has submitted that the petitioner fi1ed the application for appeals on demarcation against the panchanama in R.No.G8/1804/87 and if the said application is under iimitation the respondent authorities would consider the same by following due procedure laid down under law and conduct survey and demarcate the subject land by fixing boundaries

It is settled law that the Survey Department has the authority to conduct survey and demarcate lands in accordance with the provisions of the Telangana Land Revenue Act, 1317 Fasli (Act No. VIII of l3l7 Fasli), the Telangana Survey and Boundaries Act, 1923, and the Rules framed thereunder. The Government has issued various circulars specitying the conditions for conducting surveys, particularly F-Line (field measurement) surveys. Individuals requesting such surveys are re uired to submit 4 EVV, J Mp 35522 2O25 specillc documents, and if the conditions stipul rted in the circulars are fulhlled, the survey and bounde ry hxation may be conducted. The Commissioner, Survey, I ettlements and Land Records, exercising powers under th: Telangana Survey and Boundaries Act, 1923, issued relevzL tt circulars from time to time vide Rc.No.N 1 /65 43 I )9 , dated 25.07.2OOI, Rc.No.N1/l4O8l07, dated 13'0i' ZOO7, and Rc.No.N2/ 174l l2OJ'O, dated 18.05.2010 stil'r Llating the conditions for conducting survey of private 1el ds and as per the said circulars, if the petitioner fu[: ils a1l the conditions of the said circular, it is an obligzLl ton for the respondents to conduct survey within the time ;pecihed in the said circulars. In view of the aforesaid discussion, this (l rurt deems 6. it appropriate to dispose of this writ petiti'r I directing respondent No.3 to examine the petitioner's ap'1 lication for appea-ls on demarcation uide No'AODO225OO0?'I '943, dated O8.01.2025 submitted for conducting sx trvey and demarcation by frxing boundary stones tr: aforesaid 5 EVV, J Wp_35522_2025 Iand and if the petitioner fulfils all the conditions mentioned in the circulars issued by the Commissioner, Survey, Settlements and Land Records from time to time, after issuing notices to all the persons interested and adjacent pattadars and after considering their objections, respondent No.3 shall conduct survey of the aforesaid land in accordance with the provisions of the Telangana Survey and Boundaries Act, 1923, as expeditiously as possible. 7 . With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
