It is stated that the father of the petitioners was the owner and possessor of land to an extent of Acs. 1O-27 guntas in Sy.No.22l situated at Jukal Village, Shamshabad Mandal, Ranga Reddy District, having acquired the same by way of oral pa-rtition among their brothers, and during his lifetime, an extent of Acs.7-2O guntas has been sold in favour of third parties; and the petitioners have succeeded the remaining extent of Acs.3-07 guntas in Sy.No.221 situated at Jukal Village, Shamshabad Mandal, Ranga Reddy District. It is the case of the petitioners that having found that respondent Nos.6 and 7 created pattadar passbooks and title deeds in respect of the subject property in collusion with the revenue officials, they have filed a case uide No.DI /1259 l2Ol8 lunder Section 9 of the Telangana Records of Rights in Lands and \l 2 Pattadar Passbooks Act, 1971, before the Joint Collector, to correct/rectify the revenue entries in the revenue records in respect of the subject lands by deleting the names of respondent Nos.6 and 7 and to incorporate their names; and pending consideration of the same, the Government has repealed the Act, 1971 and enacted new Act called as "the Telangana Rights in Land and Pattadar Pass Books Act,2O2O" (for short 'Act, 2O2O'l and as per G.O.Ms.No.4 Revenue Department, dated 12.01.2021, t}:e same was transferred to the Special Tribuna-I, Ranga Reddy District, and renumbered as Case No.ST/D1/69Ol2O2l; and the said case was dismissed uide order dated O8.O2.2021 stating that there are no sufficient records for correction of the entries in respect of land admeasuring Acs.5-12 guntas in Sy.No. 18 situated at Jukal Village, Shamshabad Mandal, Ranga Reddy District. It is further stated that having found the typographical error i.e., Acs.S- 12 guntas in Sy.No.lB instead of Acs.3-O7 guntas in Sy.No.22 1, in the said order, the petitioners have filed a petition under Order VI Rule 17 r /w Section 15 1 CPC and also a memo dated 29.O3.2022 to rectify the said error, but the revenue offrcials have passed an order stating that it is not possible to make corrections in the said order as the District *5.., a1 \ 3 Collector, Ranga Reddy District has transferred to another place. The grievance of the petitioners is that respondent No.2 has dismissed the case by simply stating that there are no suffrcient reasons and has not eyen corrected the typographical error in the said order, which action is arbitrary, illegal and against the principles of natural justice. It is evident that while dismissing the proceedings 3. No.D7 I 1259 l2O 18-ST/ D 1/ 690 l2O2t dated OA.O2.2O2|, respondent No.2 has taken into consideration of the land to an extent of Acs.S-12 guntas in Sy.No.1B instead of Acs.S-O7 guntas in Sy.No.221 situated at Jukai Village, Shamshabad Mandal, Ranga Reddy District and except stating that there are no sufficient records for correction of the entries, respondent No.2 has not assigned any valid reasons and therefore, proceedings No.D 1/ 1259 /2OlB- ST/D1/6}O/2O21 dated O8.O2.2O21 issued by respondent No.2 is liable to be set aside.
4. Accordingly, the Writ Petition is allowed and the proceedings No.D 1/ 1259/2018-ST/D 1/ 690 12021 dated Oa.O2.2O2l issued by respondent No.2 is set aside. The respondent No.2 is directed to re-examine the case of the l t --'--,1 \ \l - \ 4 petitioners duly taking into consideration of the application and memo filed by them in respect of the lands admeasuring Acs.3-07 guntas in Sy.No.221 situated at Jukal Village, Shamshabad Mandal, Ranga Reddy District. On verihcation of the records, if it is found that the petitioners are entitled for issuance of the passbooks by correcting the entries in the revenLre records in respect of the subject lands, the respondents shall take steps for correction of the entries and if the petitioners is not eligible, the respondents are directed to pass a reasoned order within a period of eight (08) weeks from the date of receipt of a copy of this order and communicate the same to the petitioners.
