JUSTICE JUVVADI SRIDEVI I.A.Nos.l and2 of 2025 inland CRIM TNAL PETITION No. 15974 of 2024 COMMON ORDER: This Criminal petition is filed under Section 52g of BNSS by the petitioners/accused Nos.l and 2 to quash the proceedings against them in Crime No.23 5 of 2024 of police Station Chigurumamidi, Karimnagar District, registered for the offences punishable under Sections 420, 4Og, 467,46g and 471of IPC.
2. It is subrnitted by Iearned counsel appearing for the petitioner as weil as the respondent No.2, that during pendency of the present Cr.iminal petition, the parties have compromised the matter and accordingly, I.A.Nos. r and 2 of 2025 have been filed to record the compromise between them and to compound the offences.
3. Vide order dared 03.01.2025, this Courr directed the parties along with their respective counsel to appear before the Secretary, High C'ourt Legal Services Commiftee, High Court I I I I 2 for the State of Telangana, Hyderabad, for identification and to submit a report.
4. Pursuant to the above said direction issued by this Court, the parties have appeared and the Secretary, High Court Legal Services Committee, has identified the parties and submitted a report, dated 06.01 .2025 and the same is placed on record.
5. In view of the above, I.A.Nos.l and 2 of 2025 are allowed. Consequently, this Criminal Petition is allowed and the proceedings against the petitioners/accused Nos. I and 2 in Crime No.235 of 2024 of Police Station Chigurumamidi, Karimnagar District, are hereby quashed. Miscellaneous applications, if any pending, shall stand closed. //TRUE COPY// Sd/. T. It is humbly submitted that during the pendency of the above petition, with the intervention of elders and well-wishers the petitionerandaccusedNo..l&2havevoluntarilydecidedtoend their civil clisputes. The petitioner has also voluntarily decided to withdraw the complaint dated L9'12'2024 filed against Respondents/Accused No. 1 & 2. It is further submitted that the petitioner/defacto complainant and Respondents/Accused No' 1&2 have entered into an agreement dated 25.12.2024 and mutually decided to close the criminalproceedingsvideFlR235of2024datedtg'12'2024and further decided to settle their civil disputes amicably' The Petitioner and Accused No. 1 & 2 entered into a compromise deed/agreement on 25.t2.2024 in the presence of elders regarding money transaction of Rs. 55,00,000 in respect of Petitioner's land. That when the Petitioner and Respondents I I I I 1 clarlfied the transactions, Rs. 15,00,000 is yet to be received by the Petitioner and the Respondent/Accused No. 1&2 agreed to repay Rs. 15,00,000 on 31.03.20205 in view of the said terms, the Petitioner/Defacto complainant decided to withdraw the case dated t9.12.2024 5 It is humbly submitted that by virtue of said compromise, no useful purpose is likely to be served by allowing a criminal prosecution to continue and therefore filing this petition to quash the aforesaid proceedings thereby to prevent abuse of the process of court and to secure ends of justice by exercising the power of this Hon'ble Court to quash the proceedtnjs under sec.482 of Cr.P.C as Section 320 of Cr.pC would not be bar in view of the judgments of the Hon,ble Apex Court. \.
