The offences alleged against the petitioners are under Sections Ioe, 32e (4l., 324(41, 137(2), 351(3), 3O3 r/w.3(5) of Bharatiya Nyaya Sanhita, 2023 and , under Section 3(1) (r) (s) (c) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (for short'SC/STActJ. 2- The complainant lodged a complaint stating that about four months ago, his brother Srikanth fell in love with their 3 ..- neighbor, Dhan:rlaxmi, daughter of Deepak Singh, belonging to the t odh community and without informing their families, Srikanth and Dhanalaxmi got registered marriage and living separately. On O7.LL.2025, Dhanalaxmi's family came to know about the marriage and her brothers, Rohit and Yash, threatened to kill Srikanth. Fearing for their safety, Srikanth and Dhanalaxmi left their residence. On the intervening night of O7 lo8.ll.2025 at about t:30 AM, believing that Srikanth might be at home, Dhanalaxmi's brothers Rohit, Yash along with their relatives Akash, Shiva, Aniketh, Kuldeep, and others, forcibly entered the complainant's residence broke the lock, kicked the door open, and entered the house with stones. Unable to find Srikanth, they caught hold of the complainant and verbally abused him using caste-based slurs, assaulted him and his elder brothcr, Kiran Kumar, with stones and thea hands. Rohit took a steel rod from the kitchen curtain and hit the complainant on the head causing a bleeding injury. Yash picked up an empty gas cylinder lrom the kitchen and hit Kiran Kumar on his chest and shoulders, attempting to kill him. When their mother ancl sister-in-law tried to intervene they were pushed aside and threatened by the accused. The attackers also took away the mobilc phone of his sister-in-law. It is further 4 stated that Rohit and others ttren forcibly dragged the complainant to an auto garage near Sitla Mata Temple, Puranapul. There, they surrounded him, continued to abuse him with caste-based slurs and demanded to reveal Srikanth's location. They beat him with their hands and kicked his legs, and attempted to murder him, before leaving him at the spot. The complainant returned home and, with the help of patrolling police, he ald his brolher Kiran Kumar went to Mangalhat Police Station, where they were referred to OGH and from there to CC Shroff Hospital, Kachiguda and after treatment, the complainant returned home, while Kiran Kumar was under treatment. Hence, he requested the police to take action against the accused persons basing on which, police registered the case against the accused lor the above offences.

Heard Sri Parmesh Kumar, learned counsel for the petitioner in Crl.P.No.15242 of 2025, Sri T.Rakesh Singh, learned counsel for petitioner in Crl.P.No.15243 arrd Sri Abhishek Singh, learned counsel for petitioners in Crl.P.No. 15387 of 2025 and Sri D.Arun Kumar, learned Additional Public Prosecutor appearing for the respondent- S late. 5

4. The contention of learned counsel for the petitioners is that petitioners are innocent of the said allegations. As the sister of A. 1 went missing before the date of marriage, they were searching for her. The said girl went to the house of complainant, but they have not committed any offence. They further contended that some of the accused were already granted bail by the trial Court. As such, prayed this Court to grant anticipatory bail to the petitioners.

5. On the other hand, learned Additional Public Prosecutor opposed bail stating that all the accused are involved in this crime and there are allegations under SC/ST Act also. Further anticipatory bail is not maintainable in cases under the SC/ST Act in view of the recent judgment of the Honble Supreme Court in Kiran v. Rajkumar Jivraj and Anotherr, wherein it was held that when there is prima-facic case against the accused, anticipatory bail cannot be granted. Hence, petitioners are not entitled for bail and prayed to dismiss these petitions.

6. Considering the submissions made and perusal of material on record, it is seen that though the names of A.7 to A.9 is not mentioned in the FIR, it is mentioned as others and t SLP (Crl.) No.8 169 of 2025 ( ( 6 all these accused have abused the victims in the narne of their caste and one of the injured also sustained grievous injuries. Therefore petitioners are not entitled for anticipatory bail. However, petitioners are directed to surrender before tlre trial Court and hle regular bail applications. On filing of such applications, the trial Court is directed to consider the same and pass orders in accordance with law as early as possible. 7 . With the above directions, all the three Criminal Petitions are disposed of. Miscellaneous petitions, if any, pending shall stand closed.
