THE HON'BLE SRI JUSTICE NAGESH BHEEMAPAKA WRIT PETITION No.35295 OF 2o25 ORDER: Petitioner seeks a direction to respondents to receive the application form and release service connections to petitioner's property bearing H.No.2-64l25PlTNGOS/468, Plot No.468 in Phase-I, admeasu ring 222 square yards in Sy.No.25lP, situated at Kancha Gachibowli Village, Serilingampally Mandal, Ranga Reddy District.

2. Heard learned counsel for the petitioner, learned Government Pleader for Energr on behalf of Respondent No. 1, Sri N. Sreedhar Reddy, learned Standing Counsel for TGSPDCL on behalf of Respondents 2 to 4 and Sri G.Madhusudhan Reddy, learned Standing Counsel for Respondent No.5 - Greater Hyderabad Municipal Corporation.

Ms. Nikita Goenka, learned counsel for petitioner submits that in somewhat similar circumstances, while dealing with Writ Petition No. 2OL2L of 2025, this Court by order dt.14.O7.2O25 directed the respondents authorities therein to release the service connection, subject to the compliance of the statutory requirements by the petitioner therein, and hence, requested this Court to pass similar order in the present Writ Petition also. 2

4. Recently, the Hon'ble Supreme court in Rajend.ra Kumar Barjatga u. u,P. Aaas Eaqm vikas parishad.l , in the larger public interest, issued directions in addition to the directives issued in file: Directions in the matter of d.emolition of structures. Relevant for the purpose ol this case are: "(iv) All the necessary service connections, such as, Electricity, water supply, sewerage connection, etc., shall be given by the service provider / Board to the buildings only after the production of the completion / occupittion certificate. (u) Even after issuance of completion certificate, deviation / violation if any contrary to the planning permission brought to the notice of the authority immediate steps be taken by the said authority concerned, in accordancc with law, against the builder / owner / occup.ant; and the official, who is responsible for issuaqcJ of wrongful completion I occupation certificatJ shall be proceeded departmentally forthwith. (vi) No permission / licence to conduct any business / trade must be given by any authorities including local bodies of States /Union Territories in any urtauthorised building irrespective of it being residential or commercial building. (vii) The development rnust be in conformit5r with the zonal plan land usage. Since the prayer of petitioner is to receive the application form and release individual service connections, this court without going into merits of the matter, directs the respondents to receive the application of petitioner and release service connection to the subject property, subject to petitioner complying with the directions issued by the Hon'ble Supreme court in Rajendra Kumar Barjatga's case (supra) and the statutory requirements prescribed by the local authorities. 6 7 The Writ Petition is accordingly, disposed of.
