" For the purpose of reference, the facts in Crl.p.No.1S81O of 2024 ate considered Learned Single Judge of this Court, by order dated 03.01.2025, allowed Crl.P.No.1I;810 ol 2024 n respect of petitioner Nos.1, 2, 4, 5 and 6, and imposed certain conditions in respect of the other petitioners. The following is the relevant portion of the order of the learned Single Judge: "3.6. The present Criminal Petition is accordingly allowed insofar a!; petitioner Nos. L2.4.5 and 6 are concerned directing the lnvestigating Officer in Crime No.1 53 ot 2024 of Bomraspet P,)lice Station, Vikarabad District, to release the petitioners Nos. 10, 12, 34, 35 and 44 in the event of their arrest on the following conditions: i) Petitioner Nos. 1, 2, 4, 5 and 6-accused Nos. 10, 12, 34, 3li and 44 shall execute a personal bond for a sum of Rr;.25.000/-(Rupees Twenty Five Thousand only) each with two sureties each for a like sum each to the satisfaction of the lnvestigating Officer in Crime No. 153 o12024: ii) They shall appear before the lnvestigating Officer in Crime No.153 oI 2024 once in a week ie., every Monday b€rtween 10.00 A.M. and 5.00 P.N. till completion of in'restigation and filing of final report; iii) They shall co-operate with the lnvestigation Officer by furnishing information and documents as sought by him in concluding investigation; iv) They shall not interfere either with investigation or influence the lnvestigating Officer in any manner v) They shall not involve in any criminal acts which will prejudicial to fair and expeditious trial; and vi) They shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any Police Officer. vii) However, the lnvestigating Officer or other Official or constables of the said P.S. 37. The petition insofar as petitioner No.3 accused No.32 is concerned, the same is dismissed as infructuous." Learned counsel for the petitioners/accused, vide Memo bearing U.S.R. No.140107 ot 2O25, stated that petitioners have been complying with the conditions imposed by this Hon'ble Court by its order dated 03.01 .2025. The said fact is ascertained by the learned Additional Public Prosecutor, who submits that the accused/petitioners in all three Criminal Petitions have been cooperating with the lnvestigating Officer whenever called for investigation and are presenting themselves on the days as directed. It is submitted by learned counsel for petitioners that petitioners in all three Criminal Petitions are farmers, have certain health issues, and it is becoming difficult to them to travel every Monday to police station, as it is one of the conditions imposed. It is further submitted that petitioners are agriculturists undertaking agricultural activities in their fields and that their presence is required to take proper care of the crops which will be coming up for harvesting. ln their absence, the agricultural operations and crops may suffer. lt is pointed out that considerable hardship is put on the petitioners due to their travel to the Police Station, as one full day in a week is being lost \ ithout attending to agricultural activities. Lea'ned counsel for the State has submitted that the investigation is on the verge of (:ompletion and FSL report is awaited, and that petitioners have been complying with the conditions imposed by the learned Single Judge. Having considered the entire factual matrix and in view of the fact that the conditions are imposed on 03.01.2025 in Crl.p.No..l5810 of 2O24, (conditions imposed are similar in nature in all three Criminal petitions) and all petitioners/accused being agriculturists, this court is of the considered opinion that, as nine (9) months have elapsed and the petitioners have been cooperating with the investigaticn, this court is inclined to show indulgence in relaxing the conditions of this court. Needless to state, if the petitioners/accused try to influence witnesses or tamper witlr evidence in any manner whatsoever, this relaxation of bail conditions shall auton!atically stand vacated. Apart from certain other conditions imposed by the learned Single Judge in orders pas:;ed on various dates, this Court is inclined to modify Condition No.2 in all the three criminal Petitions to the extent the petitioners/accused shall appear before the lnvestigating officer in the various crimes on every first Monday of every month between 10:00 A.M. and 5:00 P.M. tilt completion of investigation and filing of the final report i.e., once in a month. The other conditions shall remain in toto and shall be complied with by petitioners.
