I to 4; learned Assistant Government Pleader for Revenue appearing on behalf of respondent No.5 and learned Assistant Government pleader for Home appearing on behaif of respondent Nos.6 to 8. With their consent this writ petition is taken up for disposal at the admission stage itself. 2 This writ petition is filed seeking following prayer:- "...declaring the actions of the Respondent Nos.j to 5 in proposing to open a Wine/ Liquor Shop No.27 in premises No.4-3O/ 2, situated at SN Colony, Ramchandrapuram ViIIage, Sanga Reddg District, Telangana as arbitrary and illegal on Order or Orders this Hon'ble Court maA deem fit and proper in the circumstance s of the Case..."

The facts of the case in brief as stated a_re that petitioners are residents of Ramachaldrapuram Village, Sanga Reddy District and their houses are facing the National High Way No.65 leading from Hyderabad to Mumbai via Sanga Reddy. It is l i \ ! .t \ 2 submitted that petitioners carne to know thar a Wine/Liquor shop is proposed to be opened in the premises vhereby ITI i.e., Sri Krishna Devaraya private ITI (Affiliatecl to N I VT, Nevr. Delhi), having strength of more than 2oo students is loc rted witl-rin ro0 meters of tlre p5opose.d wine shop. Learned cour rel submits that as per Government Rules, no Wine/Liquor Shop rhall be opened at a place within 100 mbters radius of Educatiorr tl Institution or place of worship. Questioning the same, the pres,r nt writ petition is filed

Learned Assistant Government pleader for ,rohibiti.n and Excise placed a copy of instructions issued b1 I rohibition and Excise Inspector, SHO patancheru and would sult nit that as per the Gazette issued, there are 6 wine shops in Bhri athinagar and Ramachandrapuram and as of now the Inspect rr, prohibition and Excise did not receive proposal for lirine shop : nd if the same is received, shall verify whether the proposed prer- :ises u.ould be in conformity u'ith Rule 25 of relangana Excise ((.r ant of Lrcense of Selling by Shop and conditions of License) Ru es, 2Ol2 and, will forward the proposals for issuance of license.
