3. Perusal of the record would reveal that the peti :oner has flled the aloresaid suit in O.S.No.2l45 of 2022 against I e respondents secking declaration of title and permanent injun,: icn. It is the specific contention of the petitioner that respondent I o. I was set e-r parte tn the year 2023 itself and he has filed ar Interlocutory Application uirle LA.No.908 of 2024 before the lear red trial Court seelii.g to ser aside the said ex parte order antl c.nit rrirn to 2 contest the said suit. Though the said I.A. was flled in the year 2024,leamed trial Court is not disposing the said I.A. anci also the said suit, in accordance with law, as expeCitiousli as possible. 4 . During the course of hearing, it is also brought to the notice of this Court that defendant Nos.2 to 5 in the said suit were also set ex parte. Perusal of the piaint filed by petitioner herein would reveal tlrat petitioner - plaintiff was aged about 54 years, r,vhile respondent No.l - defendant No.l was 73 years old as on the date of tiling of the said suit. They are now aged 57 years and 76 lears old respectively. They are senior Citizens. The suit is for declaration of title and perrnanent injunction. The year 1999 was observed as "lnternationai Year of Older Persons". In vier.v of the "National Policy fbr Older Persons" adopted by the Govemment of lndia, the erstwhile High Court of Andhra Pradesh at Hyderabad issued a Circular vide ROC.No.4790/19991OP Cell-E. dated 02.11.1999 j directing all the Judicial Officers in the State to identi i'and dispose of rnatters in rvhich persons above "65 years" of aP( ':lre involved, on priorit,v basis.
