HON’BLE SRI JUSTICE G.V.SEETHAPATHY Civil Revision Petition No.1812 of 2011 Between: Thummanapelly Limbadri & another And: Anagandula Srinivas & 3 others … Petitioners … Respondent HON’BLE SRI JUSTICE G.V.SEETHAPATHY Civil Revision Petition No.1812 of 2011 ORDER: This revision petition is filed seeking a direction to the Court below to dispose of IA No.21 of 2010 in OS No.11 of 2010 on the file of the Junior Civil Judge, Nirmal.
#2. Heard the learned counsel for the petitioners.
#3. The petitioners herein filed suit for permanent injunction restraining the defendants from in any way interfering with the possession and enjoyment of the suit path way. Along with the suit, they filed IA No.21 of 2010 for temporary injunction under Order 39 Rule 1 CPC pending disposal of the suit.
#4. It is stated that the respondents-defendants have entered appearance and filed counter also in IA No.21 of 2010 in April 2010. It is stated that the matter is still pending before the trial Court. The only grievance of the petitioners is that there is urgency in the matter, hut however, IA No.21 of 2010 has not been taken up for disposal. As the said IA No.21 of 2010 is pending consideration before the trial Court, it is neither just nor proper to go in to the merits of the case. Therefore, the trial Court is directed to dispose of IA No.21 of 2010 within a period of two months from the date of receipt of the copy of this order.
