Petition under Article 226 of the Constitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents police particularly the 4th respondent police in calling the petitioner to the police station by interfering into the civil disputes on the influence of the unofficial respondent no.5 giving the threatening calls to the petitioner by the respondents police without having any valid reasons by directing the petitioner to settle the matter with the Sth respondent in connection with the agricultural land in Sy trlo. 24129, admeasurig Ac.Z.26 gts situated at Syedguda Revenue Village, Chinnagolconda Gram Panchayath, Shamshabad tMandal, RR District wherein a suit is pending filed by the petitioner against the unofficial respondent no.5 in OS l'lo 180 of 2024 on the file of court of the ll Additional Junior Civil Judge, Rarrga Reddy District at Rajendra Nagar is illegal, arbitrary and against the princil:les of natural justice and also violative of Articles 14, 19,21 and 300-A of the Constitution of lndia and consequently direct the respondents police not to interfere into the civil disputes and not to harass and not to call the petitioner to their police station without having any valid reasons in the interest of justice. lA NO: 1 OF 2025 Petition underSection 151 CPC praying that in the circumstances stated in the affidavit filed in support of the writ petition, the High Courl may be pleased to Direct the respondents police particularly 4th respondent police not to interfere into the civil disputes by harassing the petitioner by giving threatening calls to the petitioner directing to come to the police station by settling the matter with the unofficial respondent no.5, pending disposal of the main writ'lletition. With their consent, this writ petition is being taken up for disposal at the admission stage itself.

This writ petition has been filed seeking to declare the action of the respondents police particularly the 4th respondent in calling the petitioner to the police station ancl irrterfering into the civil ciisputes and threatening the petitioner to settle the matter with tl".e 5th respondent in connection with the agricultural land admeasuring to an extent of Ac.2.26 gts, in Sy No.24/29, situated at Syeclguda llevenue Village, Chinnagolconda Gram Panchayath, Shamshabad Mandal, RR District, inspite of pending OS No.180 of 2024, flled by the petitioner against the unofficial rcspondent No.5 on the file of learnecl II Additional Junior Civil Judge, Ranga Reddy, District at Rajendra Nagar, is illegal, arbitrary and against the principles o[ natural justice and also violative of Articles 14,19,21 and 300A of the Constitution of India and consequently direct the respondents police not to interfere into the civil disputes, not to harass and not to call the petitioner to their police station, without having any valid reasons.

The learned Assistant Government Pleader for Home appearing for respondent Nos.1 to 4, placed on record instructions issued by Sub-lnspector of Police, Shamshabad I'olice Station, Cyberaba,l Commissionerate, wherein it 2 is submittecl that respondent No.5 on L4.77.2025, lodg<:d a complaint before respondent No.4 against petitioner and others regarding cheating and breach of trust in r:espect of land admeasuring to an extent ol Ac.4.00 gts, in Sy No.24/29, situated at Syedguda Revenuc Village, Clrinnagolcontla Grartn Panchayath, Shamshabad Mandal, RR Dishict. On sut:h complaint, Critne No.688 of 2025 dated 1.4.11.2025 was registered under Se ctions 316 (2),318(4) BNS and the petitioner was arrayed as accused No.3 and she is requirecl for the purpose of investigation. It is further subrnitted that sor11e evidence has to be collected and the case in under investigation anrl a-l'ter contprlction of investigation, appropriate report will be filecl before the c-oncerned Court.

Learned Assistant Government Pleactcr for Home strbmits that except conducting investigatiory the respondent No.4 neither interfered in the civil dispute not tl'rreatened the petitioner to settle the dispute with respondent No.5. It is further submitted that the petitioncr insteacl ot r:o-operating r,r,ith the pending investigation in Crime No.68B of 2025 datecl 74.17.2025, har{ filed this writ petition.

Recordilrg the submissions made by learned cou:rsel appearirlg on either side, without expressing any opinion on the merits ol'the case and since the investigation is pending in Crime No.688 of 2025 datecl 1.4.11..2025, this Court deems it appropriate to dispose of the writ petition directing respondent authorities to follow due procedure as conternplated uncler law for further course of action.
