4. Irarned Assistarrt Government Pleader for Ftrome, however, contends that the police authorities never received tlre alleged reprcsentation dated 27.07.2AL6, s clairned byth. paitipners. It is further submiued that, even assuming the police failed to take appropriate action, the petitionen had adequate remedies available to them trnder the Code of Giminal Procedure, L973 (G.P.C)/Bharatiya Nrg*ik Suraksha Sanhita 2023 (BI{SS). \0tthout exhausting such staffiory remedies, th. petitioners have direcdy approached this C-ourt under Ardcle 226 of the C-onstitution of Indt , renden the vzrit petition not mainainable.

The subsance of the petitioners'contention ir ,hrn, putsuanr to their representation, the respondent police authorities (Nos. 1 to 4) failed to provide the requested protection Ftrovrever, arLy inaction on the pan of the police ought to have been plaged before the higher police authorities or, altematively, before the jurisdictional Ivlagistrate under the remedies prescribed in the Cr.P.C/BNSS. \Tithout availing these effecdve statutory remedies, \ t" 3 apprca:hing this Coun under Article 226 of the C-orstinrtion of India has consistendybeen held to be impermissible.

8. In light of the setded legal posirion and in the absence of any exceptic,nal circumstances, the present writ petition is held to be not maiatainable. Ftrowever, liberq. is reserved to rhe pedtioners to avail themselves of rhe appropriate remedies available ,nder law, should the cause of action still survive.
