This Criminal Petition and LA. Nos. 2 & 3 ot 2024 coming on for hearing, upon perusing the Memorandum of Grounds of Criminal Petition and affidavit and Joint Memo of Compromise in l.As and upon hearing the arguments of Sri M Rathan Singh, Advocate for the Petitioner and the Public Prosecutor on behalf of the Respondent No. 1 and of Sri John Singamani Joseph for the Respondent No. 2. The Court made the following: Common Order HON'BLE SMT. JUSTICT' JUVVADI SRTDEVI I.A.Nos.2 and 3 of 2024 in/and CRIMINAL PBTITION No.15845 of 2024 COMMON ORDER: This Criminal Petition is filed under Section 528 of BNSS by the petitioners/accused Nos.3 and 4 to quash the proceedings against them in C.C.No.87 of 2024 on the file of Junior Civil Judge-cum-XVII Additional Metropolitan Magistrate, Maheshwaram, Cyberabad at Maheshwaram, Rachakonda District, registered for the offences punishable under Sections i20B, 406,420 r/w 34 of IPC.
2. lt is submitted by learned counsel appearing for the petitioners as rvell as the respondent No.2, that during pendency of tl.re present Crirninal Petition, the parlies have compromised the matter and accordingly, LA.Nos.2 and 3 of I 2024 have been filed to record the compromise between them and to compound the offences.
3. Vide order dated 26.12.2024, this Court directed the ( parlies along rvith their respective counsel to appear before the Secretary, High Court Legal Services Committee, High Court for the State of Telangarla, Hyderabad, for identification and to submit a report.
4. Pursuant to the above said direction issued by this Cou;.t, the parties have appeared and the Secretary, High Court Legal Services Comrnittee, has identified the parties and submitted a report, dated 28.12.2024 and the same is placed on record.
5. In view of the above, I.A.Nos.2 and 3 of 2024 are allowed. Consequently, this Criminal Petition is allowed and the proceedings against the petitioners/accused Nos.3 and 4 in C.C.No.S7 of 2024 on the file ol- Junior Civil Judge-cum-XVII Additional Metropolitan Magistrate, Cyberabad Maheshwaram, are hereby quashed.
