Counsel for the Respondents No.1,8,1 O,11,13,15 to 23: Sri M. Venkat Ram Reddy Counsel for the Respondents No.2 to 7,9,12,14: None Appeared The Court delivered the following: JUDGMENT t I I I I I I I I , ) t t t i I i l I : l HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI AND HON'BLE SMT JUSTICE TIRUMAI.A DEVI EADA LAA .No.15 OF 2012 IUDGMENT: (PerIIon'b/e Si lknie Ablitanrt krnarJtnriti) Aggrieved by the judgment and decree dated
23.02.200L passed in O.P.No.5 of 1995 by the Senior Civil Judge, Miryalguda, the present Appeal has been filed by the appellant.
2. Ffuard leamed Govemment Pleader for Appeals appearing for the appellant and Sri M.Venkat Ram Reddy, leamed counsel appearing for respondent Nos.l, 8, 10, 11, 1,3,1,5 to 23.
3. It is the case of the appellant that the land to an extent of Ac.05.10 gunras situated at Anumula Village, was acquired for Nagarjuna Sagar Left Gnal work frorn the respondents in pursuance of the Notification dated
06.06.1983 issued under Section 4 (0 of the Land Acquisition Act, 1894 (for short 'the Act). The Land acrtrisition Officer has passed an Award on 22.02.1986 and, 2 fixed the market value at Rs.1500/- per acre for dryland and RS.2,O0O/- per acre for converted wet land. Being not satisfied with the quantum of compensation awarded by the Land Acquisition Officer, the respondents - sought reference under Section 18 of the Act and the Land Acqusition Officer has rcferred the case to the Reference Court and the same was numbered as O.P.No.5 of 1995. \X/ithout appreciating any of the contentions raised b1'the appellant, the Reference C-ourt uide iudgment dated 23.02.2001 enhanced the compensation to Rs.45,000/- Per acre. Ffunce, the present appeal.
4. Leamed Govemment Pleader appearing for the appellant had contended that there was no basis for the Reference C-ourt to enhance the comPensation from Rs.1,500/- per acre for dry land and Rs.2,000/- per acre for converted wet land rc Rs.45,0OO/- per acre. Therefore, appropriate orders be passed in the appeal by setting aside I I i 3 ,11 the judgment and decree dated 23.02.2001 passed by, the Reference C-ourt in O.P.No.15 of 2012.
5. Leamed counsel appearing for the respondent Nos.1, 8, 10, 11, L3, 15 to 23 had contended that the Reference Clurt has relied upon Exs.Al & A2-sale deeds, dated 14.06.1979 U.20.06.1983. As per the said sale deeds, the iands were sold for a sum of Rs.1,2O,O0O/- per acre and the lands acquired are situated in the same vicrniry. Therefore, the Reference C-ourt has rightly enhanced the compensation and also granted additional market value, interest, and statutory benefits as the lands were acquied for Nagarjuna Sagar Left C-anal. The Reference C_ourt has passed a reasoned order while enhancing the compensation and there are no merits in the appeal and the same is liable to be dismissed.
6. Flaving considered the rival submissions made by the learned counsel on either side, this Court is of the vieu. that the Reference C-ourt has rightly enhanced the 1 compensation from Rs.1,500/- per acre for dry land and Rs.2,000/- per acre for converted wet land to Rs.45,000/- per acre by relung on Exs.Al and A2, which discloses that the lands were sold @ Rs.1,20,000/- per ac,re. Therefore, this Court is not inclined to inter{ere with the order passed by the Reference C-ourt.
7. Accordingly, the Appeal is dismissed. No costs. Miscellaneous petitions, lI any, pending shail stand closed //TRUE COPY// Sd/. T. VIJAY KUMAR DEPUTY REGISTRAR \ SECTION OFFICER To,
