SUJANA CRIMINAL PETITION No.14712 of 2ol25 ORDER: The Criminal Petition is filed praying this Court to grant pre arrest bail to the petitioners who is arrayed as accused Nos.l to 3 in Crime No.56O of 2025 before the Jangoan Police Station, Warangal District, registered for the offences punishable under Sections 189(2), 189(3), 118(1), 324(4l., 308(3), 351(2) read with 190 of the Bharatiya Nyaya Sanhita, 2023 (for short 'BNSJ.
2. The case of the prosecution is that on 06.11 .2025, t!;.e de facto complainant lodged a report with the police stating that during a land survey near Survey Nos. 127 & 115/A at Pasarmadla village, Al and A2 called A3, who arrived with followers armed with deadly weapons. They pushed the complainant into a pit, surrounded him, and along with A.4 and another person, assaulted him with sticks and stones. When the complainant's friend Ram and nearby farmers tried to intervene, they too were attacked and threatened with dire consequences. The accused tore the clothes of complainant, 2 snatched a gold chain (3 thulas), two rings (2.5 thulas), and took Rs. 3O,2OO/- cash, as such requested legal action against them. Based on the said complaint, the police registered a case for the aforementioned offences.
3. Heard Sri P. Ravi Kiran, learned counsel appearing on behalf of the petitioners as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent - State.
4. Learned counsel for the petitioners submitted that they are innocent and have been falsely implicated in the case and that a writ petition vide W.P. No.24962 of 2024 was filed against the de-facto complainant, in which an interim order regarding bonds was granted. Despite the same, the complainant continues to habitually file multiple cases with similar allegations and that there is no evidence against the petitioners, and that they were implicated only to settle civil disputes with third parries. He further submitted that all alleged offences are punishable with imprisonment of less than seven years, and therefore prayed that the Court allow the criminal petition. Therefore, he prayed the court to allow the criminal petition. \ .\ / l \ 3 I
5. Learned Assistant Public Prosecutor, on the other hand, submitted that all the alleged offences against the petitioners are punishable with imprisonment for seven years, and accordingly requested the Court to pass appropriate orders.

Considering the submissions of both learned counsel and upon perusal of the material on record, it is observed that the main allegations are against Accused No.3, who instigated the other accused to commit the offence. Hence, the plea of Accused No.3 is dismissed, and he is directed to surrender before the trial Court. Accused Nos.l and 2 are directed to appear before the Investigating Officer on or before 12.12.2025 between 11:OO a.rn. and 05:OO p.m. The directed to follow the Investigating Officer, in turn, is procedure laid down under Section 35(3) of the BNSS (previously Section 41-A of the Cr.P.C.) as well as the guidelines formulated by the Hon'ble Supreme Court in Arnesh Kumar a. state of Bihart scrupulously. However, the accused Nos.l and 2 shall submit his defense and co- operate with the Investigating Officer as and when required by furnishing information and produce all relevant '(zora) 8 scc 273 \ i I 4 documents/material required for the purpose of the investigation and the Investigating officer shall consider the same before filing appropriate report before the learned Magistrate concerned. 7 Accordingly, the Criminal Petition is disposed of' Miscellaneous applications, if any pending, shall also stand closed.
