Petition under Article 226 of lhe Constitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an order or direction more particularly one in the nature of writ of mandamus or any other appropriate writ declaring the action of the respondent No.2 in not granting permission for construction of the residential building consisting of Ground + First Floor in her plot of land admeasuring 181 .5 Sq. Yds, situated at Lingannapet Village, Gambhirraopet Mandal, Rajanna Sircilla District, considering the online Application No. '165, dated 26-03-2024, even though the respondent No. 3 authority through orders dated 30-07 -2024 directed the respondent No.2, is nothing but arbitrary, illegal, null and void and violative of principles of natural justice and also violative of Articles 14 and 21 of the Constitution of lndia and also violative of the rules of the Telangana Gram Panchayath Land Devetopment (Layout and Building Rules) 2002. MADHAVI DEVI \\'R.IT PETITTON N0.34220 0F 2025 REI)Ro In this Writ Petition, the petitioner is challenging the inaction on the part of respondent No.2 in granting permission for construction of a residential building consisling of Cround + First Floor in her plot of land admeasuring i81.5 squarc yards situated at Lingannapet Village, Garnbhirraopet Mandal, Rajanna Sircilla District without considering the online application No. 165 o1'the petitioner dt.26.03.2024 in spite of the directions olthis Court in W.P.No. 13889 of 2024 dt.05.06.2024, as illegal and arbitrary.

It is subrnitted that the petitioner had submitted an online application on 26.03.2024 and when the same was not considered and no orders were passed thereon, the petitioner approached this Court by filing W.P.No. 13889 of 2024 and, this Court, vide orders dt.05.06.2024, directed respondent No.2/Grarn Panchayat to consider the representation filed by the petitioner on 26.03.2024 through online and to pass appropriate orders thereon in accordance with law. It is submitted that ., 'i/.P. No.34220 of2025 thereafter, the respondents have issued a communication dt.|1.07.2024 stating that the plan did not match with site plan and therefore, application of the petitioner has bcen rejected and subsequent thereto, the petitioner has filed appeal petition bcfore the District Panchayat Officer on 19.07 .2024 requesting for reconsideration ol her application. Horvcver, the same was not considered and therefore, the petitioner has fited the present Writ Petition.

Learnerl Standing Counsel lor respondent No.2 Gram Panchayat has flied a copy of the screen shot of the online application status olthe petitioner d1.15.A4.2024, whereunder her application has been rejected with the corrment 'difference is identified blue site map and field position site so application is rejected.' It is submitted that the same is reflected against the status colurnn of the online application of the petitioner and the petitioner ought to have verified it online. He submitted thai the same has also been communicated to the petitioner vide letter dt.?.4.06.2024 and the petitioner has to file appeal before the District Collector, Rajanna Sircilla District and upl,rad all relevant documents for consideration of her application for building permission.

Learned counsel for the petitioner submits that no such communication was received by the petitioner and now he seeks libefty to file an appeal betbre the District Collector, Rajanna Sircilla District with all relevant documents and seeks a direction to the District Collector to consider the sarnc in accordance u,ith law.

In view thereof, the Writ Petition is disposed of granting liberty to the petitioner to tlle an appcal bclore the District Collector, Rajanna Sircilla District along with all relevant docurnents and on such appeal being filed, the District Collector, Rajanna Sircilla District shall consider the same expeditiously, prelerably within a period of one month from the date of receipt of the appeal in accordance rvith law. Registry is directed to mark a copy of this order to the District Collector, Raj anna Sircilla District. No order as to costs.
