5. Per t:rt,i i:r, learned Government pleader appearrng c,n ltehalf of the respondenl; w rL.ld submit that the petitioner while seeking a(tmission into the 5th resporr r'rrt-schoor had obtained rransfer certificat€ (TC) from the Wisdom Hi_oh ! rhool, whereat he had pursued VIII and IX st,rndard; and that in the '1, rtained from the said School, the name or jhe petitioner,s father was nrr:r .oned .M.Chandra Singh..
6. Learn:, j : :lvernment pleader submits that since the 1C rbtained by the petitioner rr : m the Wisdom High School mentioned th€r n,lme of the petitioner s fu1 h r" as Chandra Singh, the 5th respondent ha J r, ntered the ! l 3 said name in its record and while forwarding the names of the students for taking SSC examination, the name of the petitioner's father was also shown as 'Chandra Singh', and thus' the same recorded in the SSC Certificate issued by the respondents-authorities' declaring the petitioner haVing passed the SSC examination in the year 2010' Learned Government Pleader would further submit that since the 7. mentioning of wrong name did not occur either on account of the clerical mistake or absurd entries being made in the school or office records of the Education Department, the present Writ Petltion as filed is not maintainable.
B. Learned Government Pleader would further submit that if the petitioner intends to correct entries relating to his father's name in the SSC Certificate, he is required to notify at his own cost in the State Gazette as to the change of his father's name and keep a copy of such notification along with the concerned certificate in terms of G.O.Ms.No. 1263' Education Department dt'06'05' 1961' Learned Government Pleader also submits that since the petitioner 9. is seeking change of the name of his father in the SSC Certificate issued in the year 2010, after a lapse of nearly 12 years' the said request cannot be considered by the respondents-authorities at this point of time'
10. I have taken note oF the respective contentions urged' 4 n; me has being 1 1. Tl,c u n the petitioner claims that his father,; shown wrr>r _ ty in the SSC Certificate, it is to be not:e C :hat in the TC obtained 5l ' rn while seeking admission into tl.re ,5ri rerspor rdent _ School from Wisclcrr iigh School, after pursuing VIII and IX standard therein, the petitioner's I; lfrer name is recorded as,M.Chandra Singh,an:l not,M.Arjun Singh' as s r( i /n in the Date of Biith Ceftificate issueo lty the Municipal Authoritres.
12. 5th It is b r;ed on the aforesaid TC obtained by the p,,)titioner, the responct€ n _ School had admitted the petitioner in thei School and Singh. I:urther, entered th: ,rme of his father as ,M.Chandra 5th responde rl 'orwarded the sarne details as the stude 1t writing SSC exam and ,t s .,ather,s name to be reflected tn the certifi, tate to the respondents-;[ rorities and thus, the said name was reccr(lecr in the SSC issue: by the respondents_authorities upon peti:ioner passing certificat€r the SSC exarn n rion 13 Though t r': petitioner had contended that since the nistake had happened at h I hands of the Wisdom High School, whr:reat he had pursued VIII lr: IX standard, before seeking admission in:o the 5th respondent - Scl r:,31, the petitioner had kept quiet for more r_hEn 13 yeas aftef Obtaining l. from the said School without seeking for correction all through this p'e i)d On the other hand' the petitioner h'rc pJrsued his further studi'll; lFter passing out SSC from the 5th responden' - School' 5 which showed the name oF the petitioner's Father as 'M,Chandra Singh,, instead of 'M.Arjun Singh'. L4. As the petitioner is now seeking for change of his father,s name in the SSC Certificate on the ground that the same is wrongly reflected, as noted hereinabove, the proper course for him to adopt is to get the change of father's name notified in the Telangana State Gazette and to keep a copy of the said gazette along with the concerned certificate, as specified in G.O.Ms.No.1263 dt.06.05.1961 or to file a suit to dectare the petitioner's father as 'M.Aqun Singh' instead of 'M.Chandra Singh'. Since, the petitioner has not undertaken the aforesaid exercrse and has approached this Court by filing this present Writ petition, this Court is of the view that no such direction, much less a direction in the nature of Writ of Mandamus, can be issued to the respondents to make correction of petitioner's father's name in the SSC Certificate, which is based on the name as reflected in the TC issued by the Wisdom High School, while seeking admission to SSC into the 5th respondent - School.
15. Though learned counsel for the petltioner has placed reliance on the decision of this Court in Sree Yashwanth Sai Venkatesh v/s. State of Telanganl, the said decision relied upon would not advance the case of the petitioner, since in the said case, the school had ' w.p.No.G692 of z0 rg dr.23.o1.zolg t I I I 6 Y-! \: committe J of the fathr Same v tO ) dt.06.05.19r t:e mistake by reflecting the name of the quar<.ian in the place r of the petitioner therein and thus, this 3our:, held that the lr be covered under Section C_1 of (i.O.Ms.No.1263 , while allowing the said Writ petition.
16. [n r ie granted t: t for the p,-.1it notified b', p before the r_r r. of the above, this Court is of the view thet no relieF can be , : petitioner in the present Writ petition. lJc w( ver, it is open :ner to take recourse either to get the nam(, of his father hlishing it in the State Gazette or to file a sL it ,br declaration , rt concerned.
