The petitioners intended to make construction of a residential house on house bearing No.16-1-14/A, admeasuring 546 square yards, situated at Saidabad Hyderabad. For that purpose, they wanted to submit an application before the respondents. The grievance of the petitioners is that the respondents are not receiving the application, on the ground that they did not obtain “No Objection Certificate” from the revenue authority. Therefore, they seek appropriate directions in this regard. Heard the learned counsel for the petitioners and the learned standing counsel for the respondents and perused the material on record. The question as to whether it is competent for the Municipal Corporation to insist on production of “No Objection Certificate” from revenue authority is no longer res integra. I n Hyderabad Potteries Private Limited Vs. Collector, Hyderabad [1] , this Court dealt with that very question and held that a local authority cannot insist on production of “No Objection Certificate” from the revenue authority. Following the same, this writ petition is disposed of, directing the respondents to receive and process the application of the petitioners, without insisting on production of “No Objection Certificate” from the revenue authority.
